    Government Spokesman Christodoulos Pashiardis said that the ruling of the English High Court in the case Orams v. Apostolides does not legalise in any way the illegal purchasing and occupying of Greek Cypriot property in the Turkish occupied areas and does not lift the illegality of the occupation of these properties.

    ``On the contrary, it certifies that the illegally occupied Greek Cypriot property belongs to its legitimate inhabitants and that any purchaser or exploiter of this property is violating another`s ownership,`` he added.

    Speaking after a cabinet meeting, Pashiardis said the European Court of Justice will have the last word on the issue, adding that irrespectively of the High Court`s ruling, ``it is the inalienable right of every Cypriot citizen to assert his illegally occupied property.``

    Pashiardis said ``the violation of another`s property has consequences in the short term and even the long term.``

    He furthermore warned that those occupying or intending to purchase Greek Cypriot property in the areas under Turkish occupation are committing a crime and are not in any way covered by the British court`s ruling.

    Pashiardis dismissed Turkish Cypriot allegations that personal efforts in the property issue could hinder efforts to solve the Cyprus problem, noting that ``the prospects of a Cyprus settlement are not affected by the exercising of personal rights but by the lack of good will and political will for a solution.``

    The Government Spokesman pointed out that it was not the Greek Cypriot side that lacked this political will.

    [02] CYPRUS - TURKEY - EU

    Government Spokesman Christodoulos Pashiardis said that the steadfast position of the Cypriot government is that Turkey must fulfill its obligations towards the European Union and the Republic of Cyprus.

    Speaking after a cabinet meeting, Pashiardis said that ``if Turkey continues to refuse to meet its obligations and the commitments it undertook, then the issue does not concern the Republic of Cyprus alone but all its partners in the EU.``

    Commenting on British press reports that the European Commission was investigating the possibility of turning to the European Court of Human Rights over Turkey`s refusal to open its ports and airports to the Republic of Cyprus, Pashiardis said ``Turkey is obliged to fully meet, without preconditions, the obligations it has undertaken towards the EU and the Republic of Cyprus.``

    [03] COMMISSION - AIR CRASH

    British pilot Robert Lascelles told the Commission of Inquiry into the causes of the ``Helios`` air crash near Athens on 14 August 2005 that killed all 121 people on board that the German pilot of the Boeing wanted to rule the game on every flight and did not take co-pilot Pampos Charalambous into consideration.

    During his cross-examination by the lawyer for the relatives of the victims Marios Hartjiotis, the witness said he had flown around forty times with Charalambous, who was "a gentleman, an exceptionally professional co-pilot," with much experience on various aircraft, and very procedural when it came to safety regulations.

    During his cross-examination by Boeing`s lawyer Xenios Xenopoulos, Lascelles said pilots flying these planes are specially trained to tackle the problems arising, and that problems in the rise or fall of temperatures have nothing to do with the safety of the flights.

    Testifying before the Commission, airhostess Despina Mantzouranou said that for the period she worked for Helios she flew eleven times with the specific plane.

    "In all flights we had various technical problems. Sometimes we had low temperatures and had to wear thick clothing, and at other times it was too hot. Most of the time it was freezing and I wore a jacket. Also, on many occasions vapours formed at the door on the left side of the plane. Once I turned the oven off and it continued to be on," she said.
