    Même si les résultats des élections ne sont pas encore définitifs, les premières indications semblent confirmer la victoire du Président actuel, M. Yeltsine. Le Président Santer et M. van den Broek le félicitent. Ils estiment qu'avec ces élections, la Russie a fait un pas supplémentaire vers la démocratie. En effet, il s'agissait des premières élections présidentielles qui, sous réserve du rapport de l'OSCE, se sont bien déroulées et qui ont connu un bon taux de participation. Le résultat provisoire des élections montre que les Russes ont tourné une page dans leur histoire et qu'ils ont opté pour la démocratie et l'économie de marché. Le Président Santer et M. van den Broek estiment que ces élections démocratiques et leurs résultats sont de bon augure pour le développement des relations entre l'Union européenne et la Russie.

    [02] Ritt Bjerregaard confirms that the Commission is taking UK to court for non-implementation of the drinking water directive

    In response to recent press reports, Environment Commissioner Ritt Bjerregaard confirms that the European Commission has decided to take the United Kingdom to the European Court of Justice for non-implementation of the Drinking Water Directive. There are two reasons for the legal action of the Commission. Firstly that some of the drinking water standards which the Directive imposes are still not being met in the United Kingdom, although the standards became compulsory in 1985. The main problem is a failure to comply with the pesticides parameter, in particular in the Greater London area. Secondly that the UK has used a system of water company "undertakings" where there are failures to comply with mandatory standards of the Directive. These "undertakings", to the understanding of the Commission, constitute an exception to the duty to enforce the standards imposed by the Directive. The "undertakings" cannot be enforced by individuals who may be affected by drinking water which does not meet the standards.

    [03] Droit de séjour: procédures d'infraction contre le Danemark, la France, l'Irlande, les Pays-Bas, la Grèce et l'Italie

    La Commission européenne a décidé d'envoyer des avis motivés (la deuxième étape de la procédure d'infraction en vertu de l'Article 169 du Traité CE) à quatre Etats membres (Danemark, France, Irlande et Pays-Bas) pour la transposition incorrecte de trois directives dans le domaine du droit de séjour (concernant les étudiants, les retraités et d'autres personnes n'exerçant pas d'activité économique). La Commission a également décidé d'envoyer un avis motivé à la Grèce concernant la pratique de soumettre la délivrance d'un titre de séjour à un ressortissant de pays tiers membre de la famille d'un citoyen de l'Union au paiement d'un droit supérieur à celui exigé pour la délivrance du titre de séjour au citoyen de l'Union. Finalement, la Commission a décidé d'envoyer un avis motivé à l'Italie pour sa pratique d'exiger un titre de séjour des étudiants qui suivent un cours d'une durée de moins de trois mois. Dans chaque cas, en l'absence d'une réponse satisfaisante dans un délai de 40 jours ouvrables suivant réception de l'avis motivé, la Commission pourrait saisir la Cour de justice. La Commission, attachée à faire du concept de citoyenneté de l'Union une réalité tangible, continuera à veiller à ce que les Etats membres n'imposent pas aux citoyens qui exercent leur droit à la libre circulation des formalités bureaucratiques ou excessives qui ne sont pas prévues par le droit communautaire.

    [04] Guides touristiques: avis motivé à l'Italie pour non-exécution d'un arrêt de la Cour

    La Commission européenne a décidé d'envoyer à l'Italie un avis motivé, la deuxième étape d'une procédure d'infraction au titre de l'article 171 du traité CE, pour non-exécution d'un arrêt de la Cour de Justice de 1991 concernant des restrictions à la libre prestation de services des guides touristiques venant d'autres Etats membres. En l'absence de réponse satisfaisante dans un délai de 40 jours ouvrables suivant réception de l'avis motivé, la Commission pourrait saisir la Cour de cette affaire pour la deuxième fois. Dans ce cas, la Commission pourrait demander à la Cour d'imposer une sanction financière sur l'Italie d'un montant calculé sur base de la gravité de l'infraction, sa durée et la nécessité d'assurer un effet dissuasif. Les atteintes à la libre prestation de services sont considérées comme des infractions graves selon les critères pour l'application de l'Article 171 adoptés par la Commission le 5 juin 1996 (voir IP/96/473).

    [05] Diplômes: procédures d'infraction contre la France, le Portugal, l'Espagne, l'Allemagne et l'Italie

    La Commission européenne a décidé de poursuivre des procédures d'infraction à l'encontre de la France, du Portugal, de l'Espagne, de l'Allemagne et de l'Italie pour des violations du droit communautaire dans le domaine de la liberté d'établissement et la libre prestation de services pour les professions dont l'exercice est subordonné à des qualifications (diplômes et expérience). Les infractions concernent la reconnaissance des qualifications de vétérinaires (France - saisine de la Cour de Justice), de médecins (Portugal); de non-salariées dans les industries alimentaires (Espagne), de conseillers fiscaux (Allemagne) et d'ingénieurs (Italie). Dans les quatre derniers cas, il s'agit de décisions d'envoyer des avis motivés (la deuxième étape de la procédure d'infraction en vertu de l'Article 169 du Traité CE). En l'absence d'une réponse satisfaisante dans un délai de 40 jours ouvrables suivant réception par l'Etat membre en question d'un avis motivé, la Commission pourrait saisir la Cour de justice.

    [06] La Commission lance un projet de recherche sur la surveillance par satellite des feux de forêt dans la région méditerranéenne

    Sur proposition d'Edith Cresson, commissaire à la recherche, l'éducation et la formation, la Commission européenne vient de décider de financer un projet de recherche sur la détection par satellite des feux de forêt dans les pays méditerranéens. FUEGO - c'est le nom du projet - va évaluer les bénéfices potentiels de l'observation en temps réel depuis l'espace pour la lutte contre ces incendies. Il devrait conduire à une définition complète des spécifications techniques du matériel (détecteurs, processeurs etc.) embarqué par satellite.

    [07] European agency for safety and health at work in Bilbao elects a director

    Hans-Horst Konkolewsky, Deputy Director-General, Danish Working Environment Service, has been elected Director of the Bilbao-based European Agency for Safety and Health at Work by the 48 members of the administrative board, representing the Member States, the social partners and the European Commission. 812 people had applied for the job.

    [08] Information and consultation of employees - review of "pre-directive" agreements currently in place

    The European Commission and the European Foundation for the Improvement of Living and Working Conditions in Dublin have published a collection of the first 51 voluntary agreements concerning information and consultation of employees, concluded by companies in various Member States in advance of the implementation of Council Directive 94/95/EC. This collection gives an overview of matters which can form part of an agreement. It provides helpful guidance for employers and employees who are currently involved in negotiations. Council Directive 94/95/EC of 22 September 1994 on information and consultation of employees requires management and employees in Community-scale undertakings and Community-scale groups of undertakings to enter into negotiations in order to establish a procedure of informing and consulting employees. The Directive must be implemented by the Member States no later than 22 September 1996. Agreements concluded before this date, on a voluntary basis, can be maintained. This means that until such agreements expire, the Directive shall not apply to the undertakings concerned.

    [09] La Commission approuve l'acquisition de Poliet par Saint-Gobain

    La Commission européenne a approuvé une opération par laquelle Saint Gobain acquiert le contrôle exclusif de Poliet SA. Saint-Gobain est un groupe actif dans la production de matériaux de construction, les conditionnements, les céramiques industrielles et les abrasifs, l'isolation, le vitrage et les canalisations. Poliet est un distributeur de matériaux de construction (68% de l'activité totale avec l'enseigne Point P) et également un fabricant de menuiseries industrielles (marque Lapeyre), mortiers, tuiles, serrurerie (marque Vachette) et divers produits en béton destinés à la voirie.

    [10] L'Espagne reçoit 59,28 millions d'Ecus du Fonds de cohésion

    Le Fonds de Cohésion européen a accordé 59,28 millions d'Ecus à une série de projets espagnols dans le domaine de l'environnement couvrant le reboisement, la gestion de déchets urbains, l'assainissement et l'épuration du milieu urbain et l'amélioration/restauration des berges. En bénéficieront notamment les régions de Madrid, du Pays Basque, de la Catalogne, des Asturies, de Castille-Léon, d'Aragon, de Navarre et de la Rioja. Le taux du concours du Fonds de Cohésion est de 80% du coût total des projets.

    [11] Ireland to receive ECU 37.7 million from the Cohesion Fund

    The Cohesion Fund is to provide ECU 37.7 million to help fund three Irish projects, namely the Clonmel Main drainage, the Tuam Regional Water Supply Scheme and the South Quays Container Terminal. The rate assistance of the Cohesion Fund is 85% of the total cost of the projects.

    [12] La Grèce reçoit 101,75 millions d'Ecus du Fonds de cohésion

    Le Fonds de Cohésion européen a accordé 101,75 millions d'Ecus à une série de projets grecs relatifs au domaine de l'environnement, et plus particulièrement aux réseaux des eaux usées pluviales, à l'adduction d'eau et aux traitements biologiques. Les régions bénéficiaires sont : Patras, Volos, Chania, Sparte, Chios, Komotini, Argos, Orestia, Rethymno, Kalamata, Tripolis et Larissa. Le taux de concours du Fonds de cohésion est de 80% du coût total des projets.

    [13] South Sudan: Commission approves ECU 13 million humanitarian aid package

    The European Commission has approved a package of humanitarian aid worth ECU 13.075 million for South Sudan. Needs in the region are still acute because of the ongoing conflict there. The aid is being channelled via the European Community Humanitarian Office (ECHO). It will enable United Nations agencies, international non-governmental organisations and the International Committee of the Red Cross to carry out practical work in the field over the next 10 months.

    [14] Kyrgyzstan: Commission approves humanitarian aid worth ECU 3.6 million

    The European Commission has approved a package of humanitarian aid worth ECU 3.6 million for Kyrgyzstan. The grant, channelled via the European Community Humanitarian Office (ECHO), will enable the Dutch and German branches of the Red Cross and other non-governmental organisations to carry out a coordinated programme over the next six months.

    [15] Afghanistan: Commission approves humanitarian aid worth ECU 7 million

    The European Commission has approved a package of humanitarian aid worth ECU 7 million for victims of conflict in Afghanistan. The grant, channelled via the European Community Humanitarian Office (ECHO), will enable aid professionals to carry out a coordinated programme throughout the country over the next six months. They will, however, concentrate on helping those living in and around Kabul, the capital. ECHO's partners in this programme are the International Committee of the Red Cross, the United Nations Children's Fund, the World Food Programme, and non-governmental organisations from France, the United Kingdom, Germany, Belgium and the Netherlands.

    [16] João de Deus Pinheiro: "le secteur privé doit être plus impliqué dans la politique d'aide au développement"

    "Le développement du secteur privé constitue l'élément clef de la dynamisation de la société civile dans les pays ACP" a déclaré aujourd'hui à Paris le commissaire européen du développement, Joao de Deus Pinheiro. S'adressant à des chefs d'enteprise réunis autour d'un déjeuner-débat du Conseil National du Patronat Français (CNPF), le Commissaire a souligné l'accent nouveau sur le rôle du secteur privé introduit dans la Convention de Lomé révisée et a annoncé que la Commission prépare une nouvelle approche encore plus ambitieuse en vue d'impliquer davantage les opérateurs économiques dans la politique de coopération du développement.

At a meeting with NGOs in Sofia today, Commissioner for the Environment, Ritt Bjerregaard said: "The costs of remedial investments and actions to protect and improve the environment in the CEECs are immense. The Governments of the CEECs are understandably worried about the high costs that a strong and effective environmental policy will require. There is, however, a different way of looking at these problems. Environmental considerations in economic reform should be seen as an opportunity rather than as a constraint. If the solution of environmental problems is given a high priority right from the beginning of transition, the full potential of directing economic development to a sustainable path can be explored."

    [18] Christos Papoutsis launches the European renewable energy export Council

    The European industry can be a world leader in renewable energy technology and is well adapted to face up to international competition and exploit the great potential for exports to gain markets worldwide. This was stressed by Energy Commissioner Christos Papoutsis in his speech at the inauguration ceremony of the European Renewable Energy Export Council (EREEC) yesterday in Brussels. The Commissioner believes that the real obstacle is how to achieve market penetration and that there is a need to inform and convince potential buyers and users of the advantages and reliability of renewable energy. In this context he expressed his full support for the Export Council and announced that he will examine the possibility of leading in 1997 a trade mission in a promising third country market, with the participation of EREEC.
