    [01] Crise iraquienne : Jacques Santer insiste sur l'application inconditionnelle par l'Irak des résolutions de l'ONU

    Faisant rapport au Collège sur son voyage au Moyen-Orient, le Président de la Commission européenne, Jacques Santer, a fortement insisté sur la nécessité d'une solution diplomatique à la crise iraquienne. L'Irak doit exécuter de manière inconditionnelle toutes les résolutions des Nations- Unies pour éviter les conséquences graves qu'entraînerait leur non-respect. Tous les efforts diplomatiques en faveur d'une solution pacifique doivent être appuyés, a dit le Président. Il est d'avis que l'ONU est le cadre approprié pour rechercher une solution à cette crise grave et il s'est félicité de la mission à Bagdad que vient d'annoncer le Secrétaire Général des Nations-Unies, Koffi Annan. Jacques Santer a informé la Commission de la position unanime de tous les Chefs d'Etat et de Gouvernement qu'il a rencontrés lors de son voyage, en faveur d'une solution pacifique. Ils lui ont exprimé leur extrême inquiétude devant les conséquences imprévisibles d'une éventuelle frappe militaire, tant pour l'Irak que pour toute la région, voire au-delà. La Commission, pour sa part, se préoccupe aussi des conséquences pour la mise en application des résolutions "oil-for-food" et de l'aide humanitaire pour toute la population iraquienne. Dans ses pourparlers au Moyen-Orient, le Président a aussi rencontré une grande préoccupation devant le blocage du processus de paix et une forte demande pour que l'Europe, d'ores et déjà le plus grand bailleur de fonds, ait un profil plus prononcé et joue un rôle plus actif dans ce processus. Les dirigeants des pays visités se sont exprimés clairement en faveur d'un renforcement des liens avec l'Union européenne ainsi que d'un nouvel élan à donner au Partenariat Euro-Méditerranéen, dans le cadre du processus lancé par la Déclaration de Barcelone en novembre 1995. Le voyage du Président Santer l'a amené, entre le 6 et 13 février, successivement en Egypte, Israël, Gaza-Cisjordanie, Jordanie, Syrie et Liban.

    [02] Third report on the implementation of the EU telecommunications regulatory package

    1 January 1998 marked the unrestricted opening of telecoms markets in most Member States of the European Union. The European Commission issued a report on the state of national legislation transposing the package, while at the same time taking a first in-depth look at whether that legislation is being applied effectively and to which extent national markets are actually open to competition. The Commission's conclusion is that most of the legislative framework is in place and being applied, under the supervision of the national regulatory authorities. These national measures also appear to be producing their intended effects in practice, although, given that markets are only just getting into their stride, the Commission will continue to monitor this aspect for the foreseeable future.

    [03] Commission recommends to end dumping of disused offshore platforms in the sea

    The European Commission adopted a Communication to the Council of Ministers and the European Parliament recommending that offshore oil and gas platforms no longer in use should not end up as waste in the seas around Europe. The Communication argues that all except for a limited number of the approximately 600 installations in European waters can be completely, safely and economically removed and taken to land for recycling and safe disposal. Future rules in this area should therefore be based on the principle of a prohibition of disposal of such platforms in the sea. According to the Communication, the only category to be exempted from the rule would be the existing large concrete platforms for which there is currently no proven technology to remove them and where the environmental impact of disposal is limited. In addition it is recognised that in exceptional cases, existing installations may be exempted from the prohibition. However, this should only happen after a detailed individual evaluation and consultation of all parties.

    [04] La Commission inflige des amendes à Samsung pour notification tardive d'une opération de concentration

    La Commission européenne a décidé d'imposer à l'entreprise sud-coréenne Samsung une amende de 33.000 Ecus pour ne pas lui avoir notifié en temps voulu son opération de prise de contrôle de la société américaine AST Research Inc. et pour avoir mis en oeuvre cette opération sans son autorisation. C'est la première fois que la Commission inflige une amende au titre du règlement sur les fusions et acquisitions d'entreprises, depuis son entrée en vigueur en 1990. Le règlement sur les fusions prévoit de manière explicite l'imposition d'amendes et d'astreintes au cas où des entreprises ne respectent pas les règles européennes en matière de notification de fusions ou d'acquisitions d'entreprises et la Commission n'hésitera pas, le cas échéant, à appliquer pleinement les pénalités prévues.

    [05] Contrôle des aides d'Etat : des procédures plus transparentes

    La Commission européenne a adopté un projet de règlement du Conseil des Ministres sur les procédures en matière d'aides d'Etat qui clarifie et renforce les règles de contrôle actuelles tout en proposant certaines améliorations. La proposition confirme le rôle central de la notification préalable des aides à la Commission et de l'interdiction pour les Etats membres de mettre en oeuvre des aides qui n'ont pas été autorisées par la Commission. Elle renforce les règles sur les points pour lesquels un système de contrôle plus efficace est clairement nécessaire, notamment en ce qui concerne le suivi des décisions de la Commission et les obligations de remboursement des aides jugées incompatibles avec le marché commun. Cette proposition améliorera la sécurité juridique pour les Etats membres et les entreprises, tout en rendant la politique de la Commission plus transparente et plus efficace.

    [06] La Commission approuve des aides en faveur du tourisme en Andalousie

    La Commission européenne a approuvé des aides d'un montant total de quelque 315 millions de Pesetas (1997-1999) en faveur du développement touristique de la zone de Doñana en Andalousie, Espagne. Ces aides en faveur des petites et moyennes entreprises visent principalement à inciter l'investissement dans la création de nouvelles activités touristiques, la formation et la promotion touristique. La Commission estime que les aides à l'investissement et à la formation prévues sont des aides en faveur du développement régional qui satisfont aux conditions établies au niveau européen et qu'elles sont compatibles avec les règles européennes en matière de concurrence.

    [07] La Commission approuve des aides régionales à la R&D en Castilla y León

    La Commission européenne a approuvé des aides régionales pour un montant maximal de 2 milliards de Pesetas pour la période 1998-2000 en faveur de la recherche et du développement (R&D) dans la région Castilla y León, Espagne. Ces aides visent principalement les projets de recherche fondamentale, les projets de recherche industrielle, les projets du développement préconcurrentiel et les études de faisabilité technique préalables à des activités de recherche industrielle ou de développement préconcurrentiel. La Commission estime que les aides respectent les plafonds établis par les règles européennes en matière d'aides à la R&D. La région de Castilla y Leon a été reconnue comme région qui peut bénéficier, au titre du Traité européen d'un régime d'aides spécial parce qu'il s'agit d'une région où le niveau de vie est anormalement bas.

    [08] Commission opens procedure against aid to Lürssen in relation to take- over of Bremer Vulkan Marine Schiffbau GmbH

    The European Commission decided to open a formal procedure to ascertain whether state aid in relation to the sale of Bremer Vulkan Marine Schiffbau GmbH to Lürssen Maritime Beteiligungen GmbH & Co. KG (LMB) was lawful. The Commission invites the German Government's comment on its objections within one month. Globally, a DM 9.6 million contribution from the Land Bremen, the Commission believes, constitutes unnotified and therefore illegal state aid to LMB, which was enabled to expand its capacity and improved its prospects to compete for navy orders. The German authorities have not yet shown that the aid was contract related, operating aid or aid granted as part of a restructuring plan that does not involve an increase in capacity, all of which may be lawfully granted under the 7th Shipbuilding Directive.

    [09] Commission opens investigation into state aid to Biotec Biologische Naturverpackungen GmbH

    The European Commission has decided to investigate the German Government's proposal to give aid of ECU 1.6 million to Biotec Biologische Naturverpackungen for the production of biodegradable starch resin on top of a non-notified aid of ECU 1.5 million to the same company. Biotec is 100% owned by the Melitta Group. The aid scheme which was notified as R&D and running from 1995 to 1998 does not appear to be in line with European State aid rules in favour of R&D : the incentive effect of the proposed and non-notified aid - an inducement for the company to carry out research which it would not otherwise have pursued - appears non-existent.

    [10] Commission to investigate state aid to Spanish ferry company Transmediterranea (Transmed)

    The European Commission opened an investigation into state financing made available to the publicly-owned Spanish company Compania Trasmediteerranea S.A. (Transmed) to exploit ferry services between the Spanish mainland and various islands. The Commission warned the Spanish authorities that they should suspend the payment of state aid to the company until its examination of the case is concluded. This decision does not imply that there can be no ferry services between Spain and the various islands. It merely calls into question the amount of subsidy that the Spanish government is making to Transmed to offset the loss the company incurs in providing a public service obligation.

    [11] Commission proposes new safety measures for roll-on/roll-off ferries and high speed passenger craft operating in the European Union

    The European Commission took another important step to improve passenger safety at sea by proposing that the operators of all passenger ferries, high speed craft out of and into ports of the European Union should apply the international safety rules laid down by the International Maritime Organisation. The proposal, which must be approved by the Council of Transport Ministers and the European Parliament to become law, marks an important departure from the current practice whereby it is the flag-state, not the port state, that is responsible for issuing safety certificates and conducting accident enquiries (although specific requirements in the national law of some countries overrides this general provision). Under this proposal, before launching a regular service, operators of ferries and high-speed passenger craft must fulfil a range of strict safety conditions. For instance vessels would have to be fitted with a voyage data recorder - the equivalent of an aircraft's "black box" that records information in case of accident. Companies would have to ensure that on board the ship's master is provided with appropriate information of shore-based navigational guidance systems and other information schemes to assist him.

    [12] Contrôles aux frontières des marchandises de contrefaçon: la Commission propose d'étendre le champ d'application aux brevets d'invention

    La Commission européenne a approuvé le rapport sur l'application du règlement (CE) 3295/94 concernant le contrôle aux frontières des échanges de marchandises de contrefaçon ou des marchandises pirates. Le mécanisme mis en place par le règlement a permis en pratique de très bons résultats. Les services douaniers ont procédé, en deux ans (de juillet 1995 à juin 1997), à 4133 interventions. Tenant compte de ces bons résultats, la Commission propose d'étendre le champ d'application du règlement à un nouveau droit de propriété intellectuelle, à savoir certains brevets d'invention comme les brevets de produits et les certificats complémentaires de protection des médicaments et des produits phytopharmaceutiques. Il est, en outre, proposé d'étendre les possibilités d'intervention des services douaniers aux zones franches et entrepôts francs ainsi qu'à toutes les marchandises suspectes dès lors qu'elles sont sous surveillance douanière. De plus, pour les titulaires de marques communautaires, la proposition vise à mettre en place une procédure simplifiée permettant de déposer une seule demande de "protection douanière" valable dans plusieurs Etats membres.

    [13] Meeting between Martin Bangemann and European Aerospace industrialists

    Martin Bangemann, European Commissioner for Industry, met yesterday in Strasbourg the chairmen of several important European aerospace companies. They discussed the restructuring of the sector recommanded in the Commission's communication "The European Aerospace Industry - meeting the Global challenge", the question how space priorities could be supported by the 5th Research Framework Programme of the European Union and the idea of a European Space Forum. The Commission has recently adopted an action plan for a Transeuropean navigation and positioning network, including satellite navigation. Last year, the Commission presented to the Council of Ministers an action plan for satellite communications, now in an advanced state of implementation. In order to make sure that these initiatives proceed in accordance with industry priorities and reflect a true European consensus, Mr Bangemann launched the idea of an industry-led European Space Forum, bringing together the space industry, operators and users of space techniques, following the example of the successful Maritime Industries Forum.
