  • [01] Commission launches formal probe into Formula One and other international motor racing series

    The European Commission has concluded a thorough investigation, prompted by a number of complaints, into the way international motor sports is organised and commercially exploited. The Commission has now formally told the Fédération Internationale de l'Automobile (FIA), the body in charge of international motor racing, that it considers the FIA to be abusing its dominant position and restricting competition. The Commission has sent the same statement of objections to two companies controlled by Mr Bernie Ecclestone : Formula One Administration Ltd (FOA), which sells the television rights to the Formula One championship, and International Sportsworld Communicators (ISC), which markets the broadcasting rights to a number of major international motor sport events. A statement of objections is a preliminary procedural document and not the Commission's final verdict on the case. One of the Commission's most significant conclusions is that many of the contracts concerning the commercial exploitation of international motor sports, particularly those involving broadcasters, were concluded on the basis of a situation unlawful under European Union competition law. These contracts would therefore have to be renegotiated if the Commission's initial view is ultimately confirmed.

    [02] Proposition modifiée de directive pour la protection des inventions par le modèle d'utilité

    La Commission européenne a présenté une proposition modifiée de directive relative au rapprochement des régimes juridiques de protection des inventions par le modèle d'utilité. Cette directive vise à harmoniser les principales dispositions des lois nationales régissant la protection des inventions par le modèle d'utilité, y compris à introduire une telle protection dans les Etats membres où elle n'existe pas. Cette forme de protection, plus souple et moins onéreuse que celle du brevet, apparaît bien adaptée aux inventions présentant un degré d'inventivité limité et ayant une durée de vie relativement courte. La proposition modifiée reprend la grande majorité des amendements proposés par le Parlement européen dans son avis de mars 1999 sur la proposition initiale de la Commission. La proposition modifiée ne remet pas en cause les principales caractéristiques du modèle d'utilité telles qu'elles ont été prévues dans la proposition initiale, à savoir un niveau d'inventivité réduit par rapport à celui requis en matière de brevet, l'absence d'examen préalable des conditions de la protection et une durée de protection limitée à un maximum de dix ans. Elle vise à renforcer la sécurité juridique et la transparence, et à assurer un meilleur équilibre entre les droits du titulaire du modèle d'utilité et les droits des tiers.

    [03] Abolition of duty-free - Mario Monti confirms benefits for citizens

    Duty free sales to travellers within the European Union (EU) will come to an end at midnight on June 30 in accordance with the unanimous decision of the Council of Finance Ministers, adopted in 1991, and as a result of the European Commission standing very firm in the face of extremely strong pressure at all levels. "This is excellent news for EU taxpayers", says Mario Monti, Internal Market Commissioner. "It ends the curious situation under which massive subsidies, worth over 2 billion euro every year, were paid to air and sea travel within the EU." Mr Monti added : "I am delighted to note that many duty free sales operators have announced that they are in a position not only to maintain retail sales to travellers, who will continue to want to shop while they travel, but also maintain their prices on the majority of goods sold by absorbing from their profit margins the VAT that will be applicable from tomorrow." "It is a compliment to democracy in the EU that the interests of a narrow-interest lobby group with seemingly unlimited financial resources proved unable to overturn a unanimous decision of EU Member States", Mr Monti conluded.

    [04] Proposition de directive du Parlement européen et du Conseil établissant des exigences de rendement énergétique applicables aux ballasts pour l'éclairage fluorescent

    La Commission européenne a adopté une proposition de directive du Parlement européen et du Conseil établissant des exigences de rendement énergétique applicables aux ballasts pour l'éclairage fluorescent, qui devrait permettre de réduire les émissions de CO² de manière rentable et d'offrir des avantages économiques importants aux utilisateurs de ce type d'éclairage tout en limitant les incidences sur les fabricants. Les exigences de rendement énergétique applicables en vertu de cette directive devraient entraîner des économies d'électricité de l'ordre de 12 milliards de kWh par an et une réduction des émissions de CO² de l'ordre de 6 millions de tonnes par an d'ici à 2020.

    [05] Positive evaluation of the third multiannual programme in favour of SMEs

    The European Commission adopted a Communication presenting the independent evaluation report of the third multiannual programme for small and medium- sized enterprises (SMEs) which shows that the programme is so far providing overall value for money. The evaluation concludes that the programme is being implemented in an acceptable, cost-effective manner. Policy actions in favour of SMEs are particularly highly rated, and generally the areas which involve most expenditure are also evaluated positively.

    [06] Banques : avis motivé contre l'Italie pour pratiques discriminatoires lors du remboursement de crédits d'impôt

    La Commission européenne a envoyé un avis motivé à l'Italie pour discrimination entre les établissements de crédit italiens et les succursales ou sièges secondaires d'établissements de crédit d'autres Etats membres. En effet, ces derniers ont été désavantagés dans le remboursement des crédits d'impôt accumulés depuis 1974. L'envoi d'un avis motivé constitue la deuxième étape de la procédure d'infraction prévue à l'article 226 (ex 169) du Traité CE, ce qui signifie que la Cour de Justice européenne pourrait être saisie si l'Italie manquait de donner une réponse satisfaisante.

    [07] Economic situation in Central European Countries

    The results of the European Commission's Spring 1999 economic forecasts for the Central European Candidate Countries (CECCs) are published today. Although the CECCs have clearly been less affected by the Russian crisis than the neighbouring economies in the CIS, the worsening international environment has further slowed down their average economic growth. After a peak of about 5% in 1995, average GDP growth has gradually declined to 2 ¼% in 1998. Consequently, for the first time since the start of the economic recovery in the CECCs in 1993, the average growth rate was lower that in the European Union (EU). A return to higher rates of economic growth is only expected in 2000, because economic developments in 1999 will still be burdened by adverse external developments. Our estimates and forecasts for average GDP growth have been revised downwards by more than 1 percentage point in 1998, 1999 and 2000. At the aggregate level, the main reason for this significant downward revision is clearly the more unfavourable international environment - not only because of the Russian crisis but also as a result of the slowdown of economic growth in the EU. However, specific reasons for this revision differ sharply between countries and between years. This forecast has been finalised in mid-March, well before the outbreak of the Kosovo. Therefore, the possible effects of this crisis on neighbouring candidate countries are not yet included.

    [08] Martin Bangemann annonce son intention de quitter la Commission

    Martin Bangemann vient de faire part au Président de la Commission européenne, Jacques Santer, ainsi qu'au Président en exercice du Conseil, Gerhard Schröder, de son intention de cesser le plus rapidement possible l'exercice de ses fonctions en tant que membre de la Commission. M. Bangemann souhaite exercer une activité professionnelle au sein de la société Telefonica. Il entend prendre ses fonctions aussitôt que possible en conformité avec le Traité.
