[I] Résultats de la Commission du 13 novembre 2001 - Outcome of Commission meeting of 13 November

  • [01] Le Président Romano Prodi salue les progrès accomplis en vue de l'élargissement de l'Union Lors de l'adoption par la Commission européenne du rapport sur l'élargissement de l'Union le 13 novembre 2001, le Président Romano Prodi a déclaré : "Le cap est maintenu. L'élargissement, responsabilité historique de l'Union et priorité politique de ma Commission, est à notre portée. Cet élargissement est possible dans le cadre des politiques actuelles et des perspectives financières 2000-2006. Les réflexions et propositions sur l'avenir de ces politiques et sur le budget futur de l'Union viendront en leur temps. Les réformes nécessaires se feront mais l'impératif de l'élargissement ne doit pas être mis en cause. L'unification de notre continent dans la paix et la démocratie s'ouvre à nous."
  • [02] Enlargement well on track 10 candidates aim to complete negotiations in 2002 In its yearly reports adopted yesterday, the European Commission underlines the substantial progress made by all candidate countries towards meeting the accession criteria for EU membership. However, the Commission also calls for further efforts to ensure the proper implementation and enforcement of European Union's rules and standards (the 'acquis communautaire') before accession. To this end, the Commission will set out an action plan to help candidate countries reinforce their administrative and judicial capacity. The negotiations will continue to be based on the same principles that have been followed so far, in particular according to the merits of each country. The negotiations will proceed in line with the 'road map' and the timetable endorsed by the European Council, which foresee conclusion of the negotiations with the best prepared countries by the end of 2002. The EU will not create new conditions for accession. This means that on all forthcoming issues, in particular those with important financial implications like agriculture, regional policy and budget, due to be addressed in the first half of 2002, the Commission will make negotiation proposals based on the existing 'acquis' and budgetary framework. The Commission considers the latter as sufficient to accommodate up to ten new Member States. Negotiations can therefore be concluded independently of decisions for financing the EU after 2006, and of other reforms in agriculture, regional policy or the future of Europe. Given the present pace of negotiations, the Commission should be able to make recommendations before the end of 2002 on those candidate countries ready for accession.
  • [03] Mieux gérer et responsabiliser grâce à l'externalisation de la gestion de programmes communautaires La Commission européenne a adopté des mesures plus spécifiques dans deux grands domaines de sa politique d'externalisation concernant la gestion des programmes communautaires : la gestion de programmes communautaires par des réseaux d'agences nationales et la sous-traitance de l'assistance technique et administrative dans l'exécution de programmes communautaires. Mme Michaele Schreyer, membre de la Commission chargé du Budget, a déclaré : "L'externalisation permet une meilleure gestion, car les effectifs permanents de la Commission, qui sont limités, ne peuvent être affectés qu'aux missions essentielles de celle-ci. Toutefois, il est clair que l'externalisation ne peut pas exonérer la Commission des responsabilités qui lui incombent en vertu des traités, des compétences d'exécution conférées par le Conseil ou de ses compétences d'exécution du budget. Externaliser une tâche nécessite le respect de certaines limites et contraintes. La continuité de la chaîne de responsabilité doit être maintenue. Cette double nécessité d'améliorer la gestion et la responsabilité se reflète pleinement dans les principes et instruments adoptés par la Commission."
  • [04] European tourism : Commission maps out ideas for the sector's future The European Commission has presented its ideas on how best to exploit the European tourism sector's competitive potential. Outlined in a Communication on "Working together for the Future of European Tourism", the Commission highlights the need to enhance cooperation on and the consistency of tourism policies among the stakeholders involved in tourism. These include the Commission, Member States, regional and local authorities, industry, associations, and tourist destinations. The Commission aims in particular to foster tourism's competitiveness and sustainability. Underlining tourism's contribution to sustainable development, with a special focus on environmental and cultural resources, is high on the list of recommendations, in accordance with the "Agenda 21" guidelines. With a view to providing the tourism industry with a political platform and improving cooperation and coordination, an annual European Tourism Forum, a key interface with stakeholder groups, is proposed. The Commission also presented a report on the impact on the sector of the September 11 terrorist attacks. It expects the knock-on effects of these attacks on tourism in Europe to be rather limited in scope and time : if properly implemented, the measures foreseen in the Communication should help alleviate the impact of any long-term negative effects.
  • [05] La Commission considère que les mesures italiennes visant la régularisation de l'économie souterraine ne constituent pas des aides d'Etat La Commission européenne a statué que les mesures italiennes visant la régularisation de l'économie souterraine ne constituent pas des aides d'Etat. Ces mesures prévoient des allègements fiscaux et des réductions des charges sociales en faveur de toutes les entreprises situées sur le territoire national qui décident de régulariser leur position en émergeant de l'économie noire. Les mesures ont été qualifiées de mesures générales.
  • [06] Commission opens investigation on ad-hoc aid granted to the Portuguese public broadcaster RTP The European Commission has decided to open the formal State aid investigation procedure of Article 88(2) EC on a number of ad-hoc measures granted to the Portuguese public broadcaster RTP. The investigation does not address the aid granted to RTP in the form of annual compensation indemnities, as the Commission is not yet in a position to conclude whether the indemnities can be considered as "existing aid" in the meaning of Article 88(1) EC. As to the ad-hoc measures specified below, the Commission opens the investigation since it has doubts whether or not the Portuguese State over-compensated the reimbursable public service costs of RTP in 1992- 1998 for an amount of euro 83.6 million.
  • [07] La Commission ouvre une enquête au sujet d'une aide que l'Espagne envisage d'accorder à l'usine Renault de Valladolid La Commission européenne a décidé d'ouvrir une procédure d'examen approfondi concernant une aide d'un montant de 18 millions d'euros destinée à l'usine Renault à Valladolid. Au stade actuel, la Commission n'a pas pu établir que l'aide envisagée respectait les critères fixés par l'encadrement communautaire des aides d'Etat dans le secteur automobile et a invité l'Espagne à lui présenter ses observations dans un délai d'un mois.
  • [08] La Commission demande la fin des discriminations fiscales en faveur des mutuelles et institutions de prévoyance françaises La Commission européenne a demandé à la France de mettre fin à l'aide résultant de l'exonération de taxe sur les conventions d'assurance accordée aux mutuelles et institutions de prévoyance. Elle propose donc à la République française des mesures utiles consistant soit à supprimer cette exonération, soit à veiller à ce que l'aide ne dépasse pas les coûts afférents aux contraintes assumées, le cas échéant, au titre d'un service d'intérêt économique général. La France devra communiquer son accord explicite et inconditionnel pour mettre en oeuvre l'intégralité des mesures utiles proposées dans un délai de deux mois.
  • [09] Décision finale négative pour une aide agricole en Sardaigne (Italie) La Commission européenne déclare le plan de restructuration des entreprises en difficulté du secteur des cultures protégées (cultures sous serre ou sous abri) présenté par la Sardaigne incompatible avec les règles du marché commun et prend une décision finale négative pour ce projet d'aide d'Etat. Le régime proposé comprend des mesures financières (amortissement et renégociation de la dette), des investissements et des mesures d'assistance technique. Le budget prévu s'élève à 30 millions d'euros (60 milliards d'ITL).
  • [10] Ouverture d'une enquête sur un projet d'aide agricole en Italie (Campobasso) La Commission européenne a décidé d'ouvrir une procédure d'examen d'aide d'Etat à l'encontre d'un projet d'aide aux investissements dans le secteur agricole dans la province de Campobasso (Italie). Le projet prévoit le financement d'activités agricoles pour l'amélioration de la qualité des produits et de la vie des opérateurs. Les bénéficiaires de ces aides sont les cultivateurs directs et les entrepreneurs agricoles à titre principal, individuels ou associés. Le budget total prévu pour le financement de ces aides est de 77.468 euros (150 millions d'ITL).
  • [11] Commission decision on two Spanish and two Italian fisheries aid schemes The European Commission has authorised the implementation of co-financed structural aid measures to the fisheries sector in Cantabria, Spain. It has also authorised an Italian scheme allocating aid to fishermen in the Adriatic who were temporarily forced to cease their activities due to the presence of mucilage in this area last year. This decision, covers only a one-month period and the Commission has opened a formal investigation into the allocation of aid to fishermen beyond this period because of the lack of any recovery plans. In addition, while it believes that compensation for the shellfish producers who were also affected by this phenomenon could be authorised, the Commission lacks the information to show that the aid did not overcompensate for the losses they incurred. As a result, the investigation into this aid scheme also covers aid to shellfish producers. The second Italian case subject to the opening of an investigation procedure concerns aid for fishermen operating in the Tyrrhenian and Ionian Seas for technical cessation of fishing activities, also in 2000. In this case also, Italy failed to submit a recovery plan. After a preliminary assessment of these schemes, the Commission has doubts about their compatibility with EU rules governing state aid.

  • [12] Romano Prodi unveils his vision for Europe's space strategy The President of the European Commission Romano Prodi will today take part in the European Space Agency's (ESA) Council meeting in Edinburgh (14- 15/11), where the cooperation between the Commission and ESA will be further cemented. Mr Prodi will tell ministers of the ESA Council that clear and specific arrangements between ESA and the Commission are needed to take forward a genuine and ambitious European Space Policy. He will suggest that such a policy should be submitted to the European Union Heads of State for political approval. Furthermore, the President will confirm that the Commission is committed to playing an active role in its partnership with ESA and will make funds available for space applications within its new Framework Programme for Research. The ESA Council will make important decisions on the future of flagship space application programmes such as Galileo and elements of the global monitoring of the environment and security (GMES) initiative, as well as on the future development of the Ariane rockets and its space programmes for the coming years.
  • [13] Commission clears joint venture between ICA Ahold and Dansk Supermarked The European Commission has cleared a joint venture which will be established by ICA Ahold AB of Sweden and Denmark's Dansk Supermarked A/S (DSG), two retail companies. The joint venture will develop and operate the hard discount concept "Netto" and possibly the hypermarket concept "Bilka" (under an ICA-related trademark) in Sweden and Norway. There is no overlap in this field of activity of the parent companies as DSG is not present on either market.
  • [14] La Commission autorise la création d'une entreprise commune entre Canal+, RTL et le groupe Jean-Claude Darmon dans le domaine des droits sportifs La Commission européenne a autorisé le groupe français de télévision à péage Canal+ SA et le groupe RTL, sis à Luxembourg, à acquérir le contrôle conjoint de l'agence française de droits sportifs Jean-Claude Darmon SA (GJCD). Dans le cadre de l'opération, Canal+ et RTL fusionneront leurs propres agences de droits sportifs, à savoir respectivement Sport+ (France) et UFA Sports GmbH (Allemagne), au sein de l'entreprise commune GJCD. Il ressort de l'analyse de la Commission que la création de cette entreprise commune n'entraînera que des chevauchements insignifiants et limités sur le marché de l'acquisition et de la revente de droits télévisuels sur des manifestations sportives, qui ne sont pas de nature à renforcer la position de Canal+ sur le marché de la télévision à péage situé en aval ou la présence de RTL en Europe. KirchMedia et l'Union européenne de radiodiffusion (UER) resteront des concurrents solides.
  • [15] Money laundering : Commission welcomes Parliament's approval of new Directive The European Commission has welcomed the approval by the European Parliament's plenary session in Strasbourg on 13th November of the proposal to upgrade the EU's money laundering Directive. The text now approved by the Parliament had been agreed in a conciliation procedure between the Parliament and the EU's Council of Ministers (see IP/01/1441). The Directive will be definitively adopted once the text has also been approved by the Council, expected shortly. It would have to be implemented by Member States within eighteen months of its final adoption.
  • [16] Inondations en Algérie : l'UE fournit une aide humanitaire immédiate d'un montant de plus de 750.000 euros La Commission européenne, par le biais de son Office d'aide humanitaire (ECHO), a réagi rapidement aux inondations qui ont dévasté l'Algérie ce week-end. Cette décision concrétise l'engagement d'aider les victimes de la catastrophe, pris lundi par le Président de la Commission, Romano Prodi. Poul Nielson, Commissaire responsable de l'Aide humanitaire et du Développement, a souligné l'importance de "montrer notre solidarité envers les victimes de crises humanitaires, où qu'elles aient lieu. La nouvelle de la tragédie en Algérie a peut-être été occultée dans les médias par d'autres événements dans le monde mais cela n'a pas empêché ECHO de réagir rapidement pour assurer qu'une assistance vitale soit apportée aux victimes."
  • [17] Remise du "Financial Times / Cerec Award", Prix européen du mécénat, par Viviane Reding La Commissaire européenne à la Culture, Viviane Reding, remettra ce soir, mercredi 14 novembre 2001, au Théâtre de Namur, le Prix européen du mécénat, à l'une des treize entreprises participant à ce concours international organisé par le Cerec (Comité européen pour le rapprochement de l'économie et de la culture) en partenariat avec le Financial Times. Créé en 1996, le "Financial Times / Cerec Award" récompense une entreprise basée en Europe qui a accordé un soutien exemplaire à un projet culturel de dimension internationale. Le Prix que remettra Viviane Reding est une sculpture réalisée par l'artiste belge Christian Claus. Lors de cette même soirée, qu'organise la Fondation Promethea, seront remis les Caïus 2001, prix du mécénat culturel belge.
  • [18] Health : European conference on antibiotic use in Europe Antibiotic resistance is a major public health threat. Understanding antibiotic usage in relation to human behaviour may provide clues to reduce antibiotic prescribing. A conference in Brussels on 15-17 November by the Belgian Council Presidency and endorsed by the European Commission will focus on current knowledge of antibiotic consumption in human medicine across Europe, the relation between antibiotics and resistance in the community and hospitals, and the determinants of antibiotic prescribing in the primary care. The conference will also initiate a standardised and harmonised surveillance system on antibiotic use in Europe. "The problem of antimicrobial resistance needs to be addressed in a continous process of actions. Strengthening coordination of efforts within the Community will be a major step", said Commissioner David Byrne, responsible for Health and Consumer Protection. He will elaborate on the Community strategy against antimicrobial resistance at the opening ceremony of the conference (see also IP/01/885).
