  • [01] Commission clears the petrochemicals part of the Shell/DEA and BP/E.ON transactions subject to commitments

    The European Commission has approved the acquisition of the German oil and petrochemicals company DEA, which belongs to the RWE group, by Royal Dutch/Shell (UK/NL), and the combination of the petrochemicals businesses of Britain's BP Plc and German company Veba, a subsidiary of the E.ON group. The two operations would have led to the creation of a joint dominant position of Shell/Dea and BP/Veba on the market for ethylene on the pipeline network "ARG+", which links the Netherlands, Belgium and Germany. The commitments offered by all parties were, however, sufficient to rule out these concerns. Shell has undertaken to grant access to its import terminal for 250 kilo tons of ethylene imports by third parties. BP has undertaken to divest two shareholdings in the ARG company which operates the pipeline network.

    [02] Ecopoints : après le Conseil européen de Laeken, la Commission fait une proposition de prorogation pour un an, renouvelable deux fois

    La Commission européenne a décidé de proposer une prorogation du système écopoints pour une période de un an (du 1er janvier 2004 au 31 décembre 2004). Cette proposition fait suite à la demande du Conseil européen de Laeken des 14-15 décembre. Si jamais les nouvelles propositions législatives sur la tarification des infrastructures n'étaient pas approuvées à temps, le régime écopoints sera prorogé pour une période supplémentaire d'un an, renouvelable encore une fois.

    [03] Enquêtes sur les accidents dans l'aviation civile : la Commission poursuit de nouveau le Luxembourg devant la Cour de justice

    La Commission européenne a décidé de saisir une deuxième fois la Cour de justice à l'encontre du Luxembourg pour ne pas avoir exécuté l'arrêt de la Cour du 16 décembre 1999 la condamnant pour la non transposition en droit luxembourgeois de la directive établissant les principes fondamentaux régissant les enquêtes sur les accidents et les incidents dans l'aviation civile.

    [04] Péages sur l'autoroute du Brenner : la Commission met l'Autriche en demeure pour non-exécution de l'arrêt de la Cour de Justice

    La Commission européenne a décidé de mettre l'Autriche en demeure pour ne pas avoir modifié les tarifs des péages sur l'autoroute du Brenner de façon conforme à l'arrêt de la Cour du 26 septembre 2000. La Commission considère que le montant du péage complet continue à être injustifié.

    [05] Sécurité maritime : la Commission poursuit le Portugal et la Suède pour non-transposition

    La Commission européenne a décidé de saisir la Cour de justice à l'encontre du Portugal et de la Suède pour non-communication des mesures nationales de transposition de la Directive 99/35/CE sur la sécurité maritime. Cette directive définit un système obligatoire de visites afin de mieux assurer la sécurité des services réguliers de transbordeurs rouliers et d'engins à passagers à grande vitesse à destination et au départ des ports des Etats membres. Elle permet aux Etats membres de procéder, participer ou coopérer à toute enquête sur les accidents et incidents maritimes survenant dans le cadre de ces services.

    [06] Commission takes Ireland to the Court of Justice for infringing roadworthiness tests legislation

    The European Commission has decided to take Ireland to the Court of Justice for not respecting EU legislation on roadworthiness tests for motor vehicles and their trailers. Member States had to adopt the necessary legislation before 1 October 2000 in order to comply with Directive 1999/52/EC. Ireland has indicated to comply de facto with the Directive concerned. However, the Commission is not in possession of any official measures to support this affirmation. More than 41,000 people are killed in car accidents each year in the EU. As outlined in the new White Paper on Transport, the objective should be to reduce by 50% the death toll on European roads by 2010. This goal will only be achieved if current legislation is implemented with determination by Member States. The Commission expects Ireland to urgently comply with EU road safety legislation.

    [07] Partage de cargaisons : la Commission adresse deux avis motivés à la Belgique

    La Commission européenne a décidé d'envoyer des avis motivés à la Belgique pour non-exécution de deux arrêts de la Cour de justice du 14 septembre 1999. La Belgique a été condamnée pour n'avoir pas ouvert aux autres ressortissants communautaires les parts de cargaisons lui revenant en vertu d'accords maritimes bilatéraux conclus avec plusieurs pays africains. Plus de deux ans après sa condamnation par la Cour de Justice, la Belgique n'a ni supprimé, ni adapté, ses arrangements en matière de partage de cargaison contenus dans ses accords avec le Togo, le Mali, le Congo, le Sénégal et la Côte d'Ivoire. La Belgique ne s'est donc toujours pas conformée à la législation sur la libre prestation de services de transport maritime. Les autorités belges ont maintenant deux mois pour prendre toutes les mesures qu'exige l'exécution des arrêts de la Cour de Justice. Dans le cas contraire, la Commission pourra saisir de nouveau la Cour en indiquant le montant de la somme forfaitaire ou de l'astreinte à payer par la Belgique.

    [08] Insurance : Commission seeks information from UK on regulation and supervision of Lloyd's

    The European Commission has decided to request the UK to provide additional information concerning the regulation and supervision of the Lloyd's insurance market. The request is the first stage of the infringement procedure under Article 226 of the EC Treaty. Based on the information currently available, the Commission has concerns about the supervision and regulation of Lloyd's with respect to the requirements of the first non- life insurance Directive (73/239/EEC). The Commission is examining the compatibility of the current regulatory and supervisory arrangements for Lloyd's, and on the basis of the information received from the UK, the Commission will decide whether or not it considers there is a violation of Community law.

    [09] La Commission propose à la Cour de justice d'imposer à la France une astreinte journalière de 316.500 euros pour cause d'inobservation persistante des règles en matière de pêche

    La Commission européenne va proposer à la Cour de justice (CJCE) d'imposer à la France une astreinte par jour de retard dans l'exécution de ses obligations en matière de prévention et de répression des débarquements et de la commercialisation de poissons n'ayant pas la taille requise. Les règles relatives aux tailles minimum de débarquement visent à prévenir la pêche et le débarquement de juvéniles, une pratique extrêmement préjudiciable au renouvellement des stocks de poissons. Il y a une dizaine d'années, la CJCE constatait que la France n'avait pas pris les dispositions nécessaires pour contrôler et surveiller la mise en œuvre d'un certain nombre de mesures techniques ni pour sanctionner les infractions commises. La France ne s'est toujours pas conformée à l'arrêt de la Cour en ce qui concerne le contrôle des débarquements et de la commercialisation de poissons n'ayant pas la taille requise. La Commission a transmis à la France un avis motivé le 17 avril 1996 ainsi qu'un avis motivé complémentaire, le 6 juin 2000. La Commission ayant constaté, lors d'inspections effectuées et sur la base des informations transmises par les autorités françaises, que la France n'avait toujours pas pris les dispositions nécessaires pour remplir ses obligations, elle a décidé de proposer à la CJCE de lui imposer une astreinte journalière tant que la décision de la Cour ne sera pas exécutée. La France peut échapper à l'imposition de l'astreinte en adoptant les mesures nécessaires pour remédier aux carences constatées par la Cour.

    [10] Telecommunications : Commission takes action against Greece, Portugal and Germany on opening of the local loop

    The European Commission has decided to open infringement proceedings against Greece, Portugal and Germany for failing to ensure that competitors are offered shared access to the local loop. The Regulation on unbundling of the local loop, adopted a year ago by the European Parliament and the Council, was designed to bring more competition to the provision of local broadband access. One of the options under the Regulation is for new entrants to offer 'DSL' (digital subscriber line) services for broadband access over the local telephone network while the incumbent continues to provide voice services over the same connection ('shared access'). There has been considerable movement on this issue in the Member States since the Seventh Implementation Report. This is a first step towards securing effective implementation of the Regulation in all fifteen Member States. Further legal action could be taken at a later stage on other aspects of the Regulation.

    [11] Rééquilibrage tarifaire en Espagne : la Commission saisit la Cour de Justice

    La Commission européenne a décidé de saisir la Cour de Justice au sujet du litige qui l'oppose à l'Espagne sur la question du rééquilibrage des tarifs de téléphonie. Les tarifs d'abonnement téléphonique de l'opérateur historique Telefónica ne sont toujours pas en rapport avec les coûts sous- jacents, et ne le seront certainement toujours pas jusqu'au début de 2003, une situation que la Commission juge insatisfaisante dans le contexte du dégroupage de la boucle locale.

    [12] Commission prepares its language services for enlargement

    The European Commission has adopted two consultative documents and an action plan on its language-related preparations for enlargement. The aim is to safeguard multi-lingualism by ensuring that costs are kept under control despite the foreseen arrival of up to ten new languages as of 2004. This will be achieved through a series of modernisation measures, including better planning and coordination among services, establishing a permanent dialogue between the language services and their clients, better use of support staff, new technologies and external resources and the reduction of translation work on draft documents. Discussions will now start with Staff Unions on issues related to working conditions of staff.

    [13] Commission adopts proposals for modifying Staff Regulations and implementing a new appraisal and promotion system for its staff

    The European Commission has adopted a set of modifications to the Staff Regulations as well as draft implementing provisions for the new appraisal and promotion system. These texts formalise the decisions adopted by the Commission on the policy substance throughout 2001, on the basis of negotiations with the Staff representatives. The Commission will now submit these proposals to the Interinstitutional Staff Regulations Committee (on which representatives of both staff and the administrations of the EU Institutions sit) for opinion. After having received the opinion, expected in March 2002, it will submit the formal proposal for the modification of the Staff Regulations to the Legislative Authority, and immediately start implementing new appraisal and promotion system.

    [14] Commission report on Committees

    The European Commission has adopted a first report on the activities in 2000 of committees established under Council decision 1999/468/EC (the so- called "comitology decision"). The report describes how the "comitology procedures" are working. In addition to statistics on the activities of all 244 "comitology-committees" which existed in December 2000, a detailed annex shows a breakdown by policy sectors. The report has been sent to the European Parliament and Council and will soon appear in all 11 official languages in the Official Journal.

    [15] Internet à haut débit : la Commission soupçonne Wanadoo (France) d'abus de position dominante

    La Commission européenne a notifié à Wanadoo Interactive, une filiale de France Télécom, une communication des griefs au sujet de la tarification de ses services d'accès à Internet par l'ADSL à destination du grand public. A ce stade, la Commission est d'avis que ces services sont tarifés à un niveau inférieur à leurs coûts, ce qui pourrait représenter un abus de position dominante au titre de l'article 82 du Traité. La technique ADSL (Assymetric Digital Subscriber Line) permet un accès à Internet à haut débit. Or, le haut débit va, dans un futur relativement proche, devenir un vecteur de distribution de contenus de plus en plus riches. Il est donc important, dans cette phase de croissance, d'éviter une captation de ce marché porteur par un seul opérateur.

    [16] La Commission autorise EdF à acquérir certaines parties de TXU Europe

    La Commission européenne a autorisé l'acquisition par l'entreprise publique Electricité de France (EdF) de trois entreprises actuellement détenues par TXU Europe au Royaume-Uni. Ces acquisitions n'entraîneront pas la création ou le renforcement de positions dominantes sur les marchés de l'électricité au Royaume-Uni.

    [17] Commission clears non-life insurance venture between Sampo, Varma- Sampo, Skandia and Storebrand

    The European Commission has given the go-ahead for financial group Sampo Oyj and pension insurer Varma-Sampo, both Finnish, to join the existing non- life joint venture company If Skadeförsäkring Holding AB (If P&C), which is currently controlled by Norwegian banking and insurance group Storebrand ASA and insurer Skandia of Sweden. As a result of the merger, Sampo and Varma Sampo acquire joint control over If P&C together with the two already existing shareholders. The proposed transaction will not lead to competition concerns in any of the markets were the parties are active.

    [18] €-11 : 3,6 milliards de pièces euro dans les mains des Européens

    Les Européens ont déjà près de 3,6 milliards de pièces euro dans leurs mains, soit près de 12 pièces par habitant de la zone euro. Les opérations de distribution des kits de pièces euro, qui ont commencé entre le 14 et le 17 décembre selon les Etats, sont partout un grand succès. Le Commissaire européen chargé des Affaires économiques et monétaires, Pedro Solbes, "se félicite de l'enthousiasme avec lequel le public a répondu à la vente de minikits. C'est un signe positif que les Européens sont heureux d'accueillir notre nouvelle monnaie".

    [19] Evénements prévus dans les pays de la zone euro sur le thème de l'arrivée de l'€uro

    L'introduction des pièces et des billets en euro le 1er janvier 2002 est un événement majeur qui marque le début d'une nouvelle ère pour le processus d'intégration européenne. L'euro est ainsi en train de devenir un élément de l'identité européenne. Tous les pays de la zone euro ont donc voulu marquer cet événement et célébrer ce moment historique par des manifestations et festivités diverses que la Commission appuie fortement et auxquelles tous les citoyens sont appelés à participer.

    [20] Le Thalys €uro parcourt le Nord de l'Europe du 21 décembre 2001 au 4 février 2002

    Ce 21 décembre, le Thalys €uro est mis en circulation pour parcourir le réseau Thalys jusqu'au 4 février 2002. La Commission européenne a choisi d'illustrer son message euro par la présentation d'une partition musicale, les notes étant symbolisées par des pièces euro. Cette gamme reprend un extrait de l'hymne à la joie de la 9ème symphonie de Beethoven, hymne européen. Thalys, premier véritable réseau ferroviaire européen à grande vitesse, véhiculera de cette façon un message euro dynamique auprès des voyageurs européens.

    [21] Green light for Leader+ rural development programmes in Abruzzo, Italy and the Balearic Islands in Spain

    The European Commission has approved Leader+ rural development programmes in Italy, Abruzzo (euro 69 million - see IP/01/1902) and in Spain, Balearic Islands (euro 9.2 million - see IP/01/1903). Welcoming the decisions, Franz Fischler, Commissioner for Agriculture, Rural Development and Fisheries, said : "These programmes aim to pilot new ideas to help build a more sustainable society, economy and environment for rural Italy and rural Spain. They aim to improve the quality of life for all those who live in rural areas. Leader+ will help to increase the added value of local products and to make the best use of natural and cultural resources."

    [22] October first estimates, September revised results - Euro-zone external trade surplus euro 7.6 billion in October 2001 ; euro 0.7 billion surplus for EU15

    According to first estimates by Eurostat, euro-zone trade with the rest of the world in October 2001 was a euro 7.6 billion surplus, compared with +1.9 billion in October 2000. The revised September 2001 surplus was 4.4 billion, against a 0.4 billion deficit in September 2000. Euro-zone trade recorded a surplus of 31.2 billion for the first ten months of 2001, compared with +8.1 billion in 2000. The first estimate for October 2001 extra-EU15 trade was a euro 0.7 billion surplus, compared with a 7.1 billion deficit in October 2000. In September 2001, there was a revised deficit of 3.1 billion, against -9.0 billion in September 2000. There was a deficit estimated at 49.8 billion in the first ten months of 2001 compared with -75.2 billion in 2000.

    [23] 200 projets et 27 pays participants : bilan de "Culture 2000" pour l'année 2001

    La Commission européenne a soutenu cette année près de 200 projets pour un montant total de 30 millions d'euros, dans des domaines variés, allant des arts vivants jusqu'au patrimoine culturel. En 2001, "Culture 2000" a également contribué à la création de réseaux d'opérateurs culturels et a soutenu les capitales européennes de la culture choisies pour 2001 et 2002.

    [24] Commission provides a further euro 7.5 million in aid in response to the humanitarian crisis in Chechnya

    The European Commission has earmarked a further euro 7.5 million to cover the priority humanitarian needs of the population affected by the Chechnya conflict. Following up on earlier decisions focusing on the winter needs of victims, this allocation extends the assistance into next spring. The main aim is to continue providing essential support to internally displaced people (IDPs) and other vulnerable groups in Chechnya itself and to IDPs in neighbouring republics. Channelled through the Humanitarian Aid Office (ECHO) which comes under the responsibility of Commissioner Poul Nielson, this decision will bring the amount allocated to the region since the beginning of the current crisis in September 1999 to almost euro 65 million making the EC is the largest donor in the area.

    [25] Commission allocates a further euro 2.28 million to support humanitarian operations in Afghanistan

    The European Commission is allocating a further euro 2.28 million to support the humanitarian aid effort in Afghanistan. This latest decision focuses on data collection and mapping, and on boosting monitoring and co- ordination, with a view to maximising the impact and effectiveness of aid operations in the country. Channelled through the Humanitarian Aid Office (ECHO), which comes under the responsibility of Commissioner Poul Nielson, this brings the amount allocated by ECHO for 2001 to euro 54.7 million.

    [26] Commission provides almost euro 2 million in humanitarian aid for health actions in North Korea

    The European Commission has taken a decision to allocate euro 1.89 million for essential health actions in North Korea. The funds will be used to procure and distribute medical kits to more than 1,700 health institutions in the country and to re-launch the production of intravenous fluids in five hospitals. North Korea's continuing humanitarian crisis, which is linked to structural economic deficiencies, has had a major impact on the health of the population. Child and infant mortality has increased, chronic malnutrition persists and there has been growth in incidence of serious diseases including diarrhoea, acute respiratory infection, malaria and tuberculosis. The country is almost completely dependent on medicines provided by the international aid community. This money will be channelled through the Humanitarian Aid Office (ECHO) which comes under the responsibility of Commissioner Poul Nielson. ECHO's implementing partners for this operation are the Danish Red Cross/IFRC (medical kits) and the French NGO Première Urgence (production of intravenous fluids).

    [27] FYROM : Commission adopts new strategic framework for assistance worth euro 110 million

    On 21 December, the European Commission adopted a five-year strategy for its financial assistance to FYROM. At the same time, it announced that over the next three years, 2002-2004, euro 110.5 million has been earmarked for FYROM to finance this strategy. The priorities set in the strategy are democracy and the rule of law; economic and social development ; justice and home affairs ; environment and natural resources. These are key goals of the Stabilisation and Association Process, the cornerstone of the EU's policy towards the western Balkans.

    [28] Commission establishes Delegation in Cambodia

    In a move set to further strengthen relations between the European Union and Cambodia the European Commission has formally established a Delegation in Phnom Penh following the signature by Commissioner for External Relations the Rt Hon Chris Patten and Senior Minister, Minister of Foreign Affairs and International Cooperation HE Hor Namhong of the Delegation's Establishment Agreement. Commenting on the event, Mr Patten said : "The opening of the Delegation crowns a steady evolution of the relations between the European Union and the Kingdom of Cambodia. It symbolises the passage of a partnership which progressed from aid for the reconstruction and rehabilitation of the country, to the consolidation of peace and democracy and is now based as well on the development of trade and investment links."

    [29] Chernobyl Shelter Fund : EU makes euro 40 million payment for 2001

    The European Commission has approved payment of euro 40 million of the EU contribution for 2001 to the Chernobyl Shelter Fund. The EU first pledged euro 90.5 million. The amount was transferred to the Fund and has been spent. At the second pledging Conference held in Berlin in July 2000, a second amount of euro 100 million to be paid in four instalments over the years 2001-2004 was pledged. The Chernobyl Shelter Fund was constituted at the end of 1997 in order to implement a project to transform the existing sarcophagus into a safe and environmentally stable system. The project is on schedule and is to be completed in 2007.

    [30] Commission clears acquisition of Risparmio Vita Assicurazione by Commercial Union Vita

    The European Commission has granted clearance under the Merger Regulation to the acquisition of sole control of Risparmio Vita Assicurazioni S.p.A. by Commercial Union S.p.A., both Italian life insurance companies (the operation was examined under the simplified procedure).
