  • [01] Commission fines eight Austrian banks in "Lombard Club" cartel case

    The European Commission has imposed fines totalling €124,26 million on eight Austrian banks for their participation in a wide-ranging price cartel. In a highly institutionalised price-fixing scheme, the CEOs of the banks met every month, except August, as the "Lombard Club", a cartel which covered the entire Austrian territory "down to the smallest village", as one bank put it with a view to fixing deposit, lending and other rates to the detriment of businesses and consumers in Austria. The cartel started well before the accession of Austria to the European Economic Area in 1994. But in this case, the Commission can only levy fines for the period starting with EU membership (1995) until June 1998, when it carried out surprise inspections at the banks' premises putting an end to the cartel behaviour.

    La Commission européenne a adopté une communication de suivi au livre vert sur la protection des consommateurs de 2001. Dans leur réaction au livre vert, une grande majorité des Etats membres et une majorité d'autres acteurs ont exprimé le souhait que la Commission élabore une directive- cadre sur les pratiques commerciales loyales (la "concurrence loyale"). Une directive-cadre harmoniserait les règles nationales en matière de loyauté des pratiques commerciales (publicité, marketing agressif, service après- vente) existant entre les entreprises et les consommateurs. Un système totalement harmonisé aurait des avantages à la fois pour les consommateurs et pour les entreprises et il compléterait le marché intérieur dans ce domaine. Les consommateurs seraient davantage disposés à faire des achats à l'étranger s'ils savaient que les règles y sont identiques. Les entreprises pourraient vendre aussi aisément à l'extérieur qu'à l'intérieur du territoire national. La Commission va maintenant procéder à des consultations dans le but de définir plus précisément le contenu d'une éventuelle directive-cadre avant de faire des propositions. Parallèlement, la Commission va maintenant élaborer une proposition visant à améliorer l'application des règles de protection des consommateurs dans l'UE, ce qui était largement souhaité dans les réponses au livre vert.

    [03] Pensions : Commission decides to attack obstacles to job mobility in pension schemes

    The European Commission has decided to attack the problem of supplementary pension rules which obstruct the mobility of EU workers when they go to another Member State to work, or even when they change jobs within their own Member State. The Commission decision to launch formal consultation of social partners is the first step towards EU action to help workers who are forced to change pension scheme when they change their employer. The Commission consultation paper analyses three key parameters of supplementary pension schemes : rules on acquisition and preservation of pension rights ; rules on transferability of pension rights ; rules on cross-border membership of pension schemes (remaining in the same pension scheme while moving to a job in another Member State). Significantly, the Commission notes that, in relation to cross-border membership, the recent political agreement allowing for pan-European pension funds will help those workers who change Member State to work and are able to stay in the same pension scheme but serious problems will still remain where workers are forced to change pension scheme. Europeans are already relatively reluctant to change jobs : in 2000, only 16.4% of EU workers had been with their employer for less than one year, compared to 30% in the US. This decision is part of the Commission's strategy to remove the day-to-day obstacles which discourage European worker mobility. Other recent proposals in this area have included an EU health card and a website with information about job vacancies throughout the EU.

    [04] La Commission présente un rapport sur les perspectives pour l'accès généralisé à la 3ème génération ("3G")

    La Commission européenne a adopté aujourd'hui une Communication intitulée "Vers l'accès généralisé aux communications mobiles de troisième génération" et destinée au prochain Conseil de Séville. Ce document fait le point de la situation en Europe à un moment où la quasi-totalité des Etats membres ont octroyé des licences pour la 3ème génération de services et réseaux mobiles, où le déploiement des premiers réseaux de 3ème génération va commencer et où les premières applications commerciales sont annoncées. La Communication identifie les principaux défis que devront relever tous les acteurs concernés si l'on veut que la 3ème génération satisfasse aux attentes et remplisse son rôle dans la mise en place de la Société de l'Information dans l'UE que la Commission souhaite instaurer par son plan d'action e-Europe 2005.

    [05] EU Civil Protection capabilities reinforced

    The European Commission has adopted a Communication taking stock of the progress made to improve the EU's preparedness to respond to the consequences of terrorist threats. This Communication follows the Commission's November 2001 Communication, which looked at how to mobilise resources, expertise and networks in the area of civil protection, in the wake of the events of 11 September. The Commission has since taken action to enhance its response capabilities. Hence, in future; a country hit by any kind of major emergency including the consequences of terrorist threats will be able to call on the help of co-ordinated EU intervention teams. These teams, which will have the latest technical resources at their disposal, will be co-ordinated by the Commission with the support of the best qualified European experts .

    [06] Commission clears acquisition of a Siemens stake in German air bearings producer AeroLas

    The European Commission has approved the acquisition by Siemens of a 10% shareholding in German air bearings producer Aerolas. The stake will give Siemens joint control in the running of AeroLas, a start-up company based in Bavaria which produces air bearings with laser technology it developed and which can be used for microchip manufacturing equipment. The deal does not pose any concerns since there will remain sufficient competition in the markets concerned.

    [07] Commission clears acquisition of VUP assets by Cinven and Carlyle

    The European Commission has granted clearance under the Merger Regulation to the acquisition of joint control by British venture capital firm Cinven and private equity fund Carlyle, which is registered in the Cayman Island, of some assets sold by Vivendi Universal Publishing. (The operation was examined under the simplified merger review procedure)

    [08] David Byrne se félicite de l'accord du PE sur l'obligation de mentionner les allergènes dans l'étiquetage des denrées alimentaires

    David Byrne, membre de la Commission européenne chargé de la santé et de la protection des consommateurs, s'est félicité aujourd'hui du vif soutien apporté par le Parlement européen en première lecture à la proposition de la Commission visant à modifier la directive relative à l'étiquetage des denrées alimentaires. Cette proposition est destinée à garantir que tous les consommateurs soient informés sur le contenu complet des denrées alimentaires et à permettre aux consommateurs souffrant d'allergie d'identifier le ou les ingrédients allergènes qui pourraient être présents. Elle signifie que tous les ingrédients ajoutés devront être énumérés dans l'étiquetage et abolira la "règle des 25%" en vertu de laquelle il n'est pas obligatoire de mentionner dans l'étiquetage les composants des ingrédients composés lorsqu'ils constituent moins de 25% du produit final. La proposition établira également une liste des ingrédients susceptibles de provoquer des allergies ou des intolérances et inclura les boissons alcoolisées si celles-ci contiennent un ingrédient figurant sur la liste des allergènes. Le Parlement a apporté des modifications qui accroissent le niveau d'information des consommateurs, améliorant ainsi la proposition.

    [09] Nitrofen : results of Food Chain Committee

    The German authorities presented yesterday a detailed report to the Standing Committee of the Food Chain on the Nitrofen contamination of cereals intended for food and feed. The source of the prohibited pesticide contamination has been clearly identified. In the light of the information and assurances provided yesterday and the measures taken so far by Germany, the Committee noted that there was no need for the moment to take additional measures. Tracing the few outstanding products is continuing in the Federal Republic. The state of progress of the investigation will be reviewed at a next meeting of the Standing Committee of the Food Chain and Animal Health this Friday, 14 June 2002.

    [10] Researchers send in thousands of new ideas for European research

    Universities, companies and research centres have sent more than 15,000 ideas for European research projects to the European Commission. More than 100,000 groups and institutions were involved in drafting the ideas ; the proposed teams involve potentially several hundreds of thousands of researchers across Europe and beyond. In a radical departure from previous programmes and for the first time, on March 20, 2002, the Commission asked the scientific community to say what they see as the most promising topics for cutting edge research in the 6th Research Framework Programme, due to be launched in autumn this year. Research Commissioner Philippe Busquin is encouraged by the massive response. "It shows that the European Research Area is becoming a reality", he said. "The strong response also demonstrates that our researchers have many good ideas. That much more funding for research is needed in Europe through a co-ordinated investment by Member States. It is an encouraging sign as we work towards the EU's target of investing 3% of GDP in research by 2010. Our researchers want to work together and share efforts with the best of their field in other countries. They want to work together in a new way at the European level, namely in projects or networks with sufficient critical mass to meet global scientific or technological challenges."

    [11] Sécurité des approvisionnements gaziers : Loyola de Palacio souligne l'importance de la déclaration Putin / Kuchma

    Cette déclaration Russo-ukrainienne, signée par les Présidents Putin et Kuchma le week-end dernier, prévoit la constitution d'un investisseur stratégique composé, à parts égales, de compagnies gazières ukrainienne, russe et européenne, qui sera en charge de la modernisation et de la gestion du transit du gaz naturel russe vers l'Union européenne. Dans ce contexte, elle rappelle l'importance de cet accord pour la sécurité des approvisionnements de l'UE, notamment en ce qui concerne l'introduction des règles d'une économie de marché dans la gestion et la sûreté du transit.

    [12] G8 Foreign Ministers' meeting : Whistler 12 & 13 June

    The European Commissioner for External Relations Chris Patten, the EU Presidency, represented by Foreign Minister Josep Piqué, and the EU High Representative for CSFP, Javier Solana will participate in the meeting of G8 Foreign Ministers in Whistler, Canada 12 and 13 June. The agenda includes discussions on : Counter Terrorism ; Afghanistan ; India/Pakistan ; Middle East ; Arms Control ; and the Western Balkans. The meeting will issue a number of statements (and the usual 'Chairman's summary'). An EU- Japan Troika Ministerial Meeting will be held in the margins.

    [13] Dégroupage de la boucle locale : la Commission organise une audition publique

    La Commission suit attentivement la question de l'accès au dernier kilomètre des lignes téléphoniques connectant les foyers européens ou, comme l'appellent les spécialistes, celle du dégroupage de la boucle locale. La direction générale de la concurrence de la Commission organise une audition publique à Bruxelles le 8 juillet 2002 afin d'analyser l'ensemble des difficultés que pose encore la réalisation du dégroupage de la boucle locale, ainsi que l'évolution de la concurrence dans le domaine de la fourniture de services et d'accès à large bande.
