  • [01] La Commission adopte le deuxième rapport d'étape sur la cohésion économique et sociale

    Michel Barnier, Commissaire européen chargé de la politique régionale, a présenté le deuxième rapport d'étape sur la cohésion économique et sociale mettant à jour l'analyse de la situation des régions d'Europe. Le rapport offre également une synthèse du "grand débat" sur l'avenir de la politique régionale de l'Union pour la période commençant en 2007, dans le contexte d'une Union européenne élargie. Il pose ainsi les jalons des propositions que la Commission publiera avant fin 2003 en vue d'élaborer une politique régionale nouvelle manière, capable de répondre non seulement aux besoins des nouveaux Etats membres, mais aussi à ceux des Quinze.

    [02] Intellectual property : Commission proposes Directive to bolster the fight against piracy and counterfeiting

    The European Commission has presented a proposal for a Directive on the enforcement of intellectual property rights. The objectives of the proposal are to harmonise national laws on the means of enforcing intellectual property rights and to establish a general framework for the exchange of information between the responsible national authorities. The proposed Directive would ensure a level playing field for right holders in the EU, reinforce measures against offenders and thus act as a deterrent to those engaged in counterfeiting and piracy. The proposal will now go forward to the European Parliament and the EU's Council of Ministers for adoption under the so-called 'co-decision' procedure. The proposal complements the recent proposal for a Regulation to facilitate seizures by customs of counterfeit goods from outside the EU (see IP/03/75).

    [03] Nucléaire : la Commission propose une approche communautaire de la sûreté des centrales et des déchets

    La Commission a adopté deux propositions de directive afin de doter l'UE d'une approche communautaire de la sûreté des centrales nucléaires et du traitement des déchets radioactifs. Ces propositions de directives, annoncées dans la Communication adoptée par la Commission le 6 novembre 2002 , ont reçu l'aval du Comité d'experts des questions nucléaires, présidé par le professeur J. R. McAulay, qui, conformément au Traité Euratom, doit examiner toute nouvelle proposition législative dans ce domaine. "Bien que nous puissions nous targuer d'avoir un excellent niveau de sûreté nucléaire dans l'Union européenne, les lacunes de la législation communautaire, à la veille de l'élargissement doivent être comblées", a déclaré Loyola de Palacio, vice-présidente en charge de l'Energie et des Transports. Ces propositions de directives sont adoptées au moment où la Cour de Justice vient de confirmer les compétences normatives communautaires en matière de sûreté des installations nucléaires.

    [04] La Commission lance une enquête sur d'éventuelles aides d'Etat en faveur de France Télécom

    La Commission européenne a décidé d'ouvrir la procédure formelle d'examen concernant la mise à disposition de France Télécom (FT), via un établissement public, d'une avance d'actionnaire sous la forme d'une ligne de crédit d'un montant maximum de €9 milliards pour faire face au remboursement de ses dettes. Compte tenu du fait que le soutien de l'Etat est apporté par le biais d'une opération financière complexe, la Commission examinera les modalités de la mise en place de cette avance d'actionnaire de manière approfondie. La procédure vise également le régime de la taxe professionnelle applicable à FT. Une procédure formelle d'examen ne préjuge en rien la décision finale. Elle a ainsi notamment pour but de donner à l'Etat membre concerné ainsi qu'aux concurrents de l'opérateur historique français l'occasion de faire valoir leurs observations.

    [05] La Commission examine l'actualisation 2002 du programme de stabilité de la Belgique (2003-2005)

    La Commission européenne a adopté une recommandation pour un avis du Conseil relatif à l'actualisation 2002 du programme de stabilité de la Belgique, présentée le 5 décembre 2002, qui couvre la période 2003-2005. Ce programme actualisé se fonde sur des hypothèses macroéconomiques conformes aux prévisions de la Commission. Il respecte les contraintes imposées par le code de conduite concernant la présentation des programmes de stabilité. Malgré le ralentissement de l'activité économique, la Belgique a pu préserver l'équilibre de ses finances publiques en 2002. En revanche, le gouvernement n'a réduit que faiblement son taux d'endettement, et le ratio de sa dette au PIB s'élevait encore à 106,1%, soit près de 3 points de pourcentage de plus que prévu dans l'actualisation précédente. Selon le programme de 2002, les finances publiques resteront en équilibre en 2003 avant d'afficher un excédent de 0,3% du PIB en 2004 et de 0,5% en 2005. Le solde budgétaire corrigé des variations conjoncturelles s'est amélioré d'environ 0,5 point de pourcentage du PIB en 2002 pour atteindre 0,2% du PIB et l'excédent devrait se stabiliser à 0,3% du PIB pendant la période 2003-2005. Le programme actualisé de 2002 respecte donc les conditions imposées par le pacte de stabilité et de croissance, à savoir un solde budgétaire proche de l'équilibre ou excédentaire à moyen terme. Le taux d'endettement du gouvernement devrait diminuer d'environ 4 points de pourcentage du PIB l'an pendant la période couverte par le programme et se chiffrer à 93,6% du PIB en 2005. La réalisation d'excédents primaires élevés pendant cette période est une condition essentielle pour la réduction de la dette publique, qui demeure très élevée. Toutefois, l'excédent primaire attendu devrait atteindre 5,6% du PIB l'an en moyenne entre 2003 et 2005, et serait donc inférieur aux 6% réalisés récemment et recommandés par le Conseil dans son avis relatif à l'actualisation de l'an dernier. De plus, le programme n'impose pas un plafond pour les dépenses primaires réelles du gouvernement fédéral et de la sécurité sociale, comme le lui recommandaient à la fois l'avis rendu par le Conseil au sujet de l'actualisation 2001 et les grandes orientations de politique économique de 2002. Le programme est partiellement conforme aux grandes orientations de politique économique de 2002. Sur la base de la recommandation de la Commission, le Conseil devrait adopter un avis formel au sujet du programme de stabilité actualisé de 2002 de la Belgique le 18 février 2003.

    [06] Commission assesses updated Stability Programme of Ireland (2003-2005)

    The European Commission has adopted a recommendation for a Council opinion on the 2002 update of the Irish stability programme, which was submitted on 4 December 2002 and covers the period 2003-2005. The programme broadly complies with the code of conduct and the macroeconomic scenario is considered realistic. The projected downward path of inflation appears however optimistic. There is therefore a significant risk to competitiveness and price stability if wage expectations fail to adapt to the changed economic environment. The outcome for the general government balance in 2002, a minor deficit, is expected to rise to over 1% of GDP over the programme period. Adjusted for the effects of the cycle however, the underlying public finance situation improves in 2003 and remains stable at around ½% of GDP for the rest of the period. Moreover, in line with past Irish practice, the budgetary targets for the final two years of the programme include large "contingency provisions" against unforeseen developments, without use of which the budgetary situation would improve. The budgetary projections also reflect the impact of significant government investment under the National Development Plan 2000-2006. At 35% of GDP the debt ratio is the second lowest in the Union. Having regard to Ireland's very low debt ratio and overall sustainable public finance position, the Commission considers that the limited underlying deficit implied by the programme targets is fundamentally consistent with the close-to-balance or surplus objective of the Stability and Growth Pact. On the basis of the Commission recommendation, the Council is expected to adopt a formal opinion on the stability programme of Ireland on 18 February 2003.

    [07] La Commission évalue le programme de stabilité actualisé de l'Espagne (2002-2006)

    La Commission européenne a adopté une recommandation pour un avis du Conseil relatif à l'actualisation 2002 du programme de stabilité de l'Espagne qui a été présentée le 27 décembre. Ce programme, qui couvre la période 2002-2006, est conforme dans ses grandes lignes au code de conduite et le scénario macroéconomique est jugé globalement réaliste. L'Espagne respecte l'objectif d'un budget proche de l'équilibre ou excédentaire fixé dans le pacte de stabilité et de croissance. La stratégie budgétaire continue de miser sur la maîtrise des dépenses courantes primaires et la baisse des paiements d'intérêts, permettant un accroissement de l'investissement public. Pour 2003 notamment, les prévisions d'un budget équilibré pourraient s'avérer quelque peu optimistes, car la croissance pourrait être moins dynamique que prévu, mais les objectifs budgétaires annoncés pour le reste de la période de programmation sont réalistes. Toutefois, la révision à la hausse de l'inflation à 2,8% au lieu des 2,4% prévus en moyenne par l'actualisation 2002 soulève des questions de fond. Le ratio de la dette des administrations publiques devrait baisser à un rythme plus soutenu que ce qu'envisageait le programme précédent, en partie grâce à une hausse de l'inflation, et devrait tomber en dessous de 47% en 2006. La Commission se félicite des initiatives prises par les autorités espagnoles pour améliorer le fonctionnement des marchés du travail, des capitaux et de produits. Cependant, la viabilité à long terme des finances publiques demeure une source de préoccupations en raison de l'impact du vieillissement de la population. Le programme actuel est plus détaillé que le précédent sur ce point, mais ne contient ni mesures concrètes ni calendrier. Il n'est donc conforme qu'en partie aux grandes orientations des politiques économiques pour 2002. On ne peut exclure le risque de voir apparaître des déséquilibres budgétaires à l'avenir. Sur la base de la recommandation de la Commission, le Conseil devrait rendre un avis formel sur le programme de stabilité de l'Espagne le 18 février 2003.

    [08] Commission assesses the 2002 update of the UK convergence programme (2001/02 to 2007/08)

    The European Commission has adopted a recommendation for a Council opinion on the 2002 update of the UK convergence programme, which was presented on 19 December 2002 and covers the period up to 2007-08. The update is broadly in line with the revised code of conduct and complies in part with the 2002 Broad Economic Policy Guidelines. Macroeconomic projections are somewhat optimistic in the short term but broadly in line with the Commission's calculations regarding the trend growth assumptions. The programme projects the general government balance to move from a slight deficit of 0.2% of GDP in 2001-02 to 2.2% in 2003-04, before falling to 1.6% in the latter years of the programme. In cyclically adjusted terms the deficit is projected to rise from 0.2% in 2001-02 to around 1.6% of GDP from 2005/06 on. Gross government debt stabilises according to the programme to around 39% of GDP from 2003-04 onwards. On the basis of current policies and forecasts, ageing populations are projected to have a limited impact on public spending on pensions as a share of GDP. Having regard to the UK's very low debt ratio and overall sustainable public finance position the Commission considers that a "small" deviation from the "close to balance or in surplus" requirement of the Stability and Growth Pact (SGP) could be envisaged for the UK. However, the deficits projected for the later years of the programme reach 1½% of GDP, both in actual and cyclically adjusted terms. Moreover, the relatively high projected deficit of 2.2% of GDP in 2003-04 is based on an optimistic 2¾% GDP growth assumption. Such budgetary developments could lead to a deficit that could potentially approach the 3% of GDP Treaty threshold and consequently would not be in line with the medium-term requirement of the Stability and Growth Pact. A 'medium-term' budgetary deficit that is small enough to ensure that the 3% deficit ceiling is not breached in any given would be consistent withthe 2002 BEPGs and the SGP. On the basis of the Commission's recommendation, the Ecofin Council is expected to adopt a formal opinion on the updated UK convergence programme on 18 February.

    [09] Commission assesses the 2002 update of the Danish convergence programme (2002-2010)

    The European Commission has adopted a recommendation for a Council opinion on the 2002 update of the Danish convergence programme, which was submitted on 29 November 2002 and covers the period 2002-2010. The Commission concludes that Denmark has continued to fulfil the convergence criteria on inflation, long term interest rate, the exchange rate and government finances. Furthermore, the projections in the programme are in compliance with the requirements of the Stability and Growth Pact, the code of conduct and with the Broad Economic Policy Guidelines. The general government budget balance is expected to show surpluses for the entire period 2002- 2010. The achievement of the targeted surpluses of 1½-2½% of GDP hinges to a large extent on the achievement of ambitious labour market reforms including an increase in labour force participation rates from already high levels. It might therefore prove to be quite a challenge to reach these targets. On the basis of current policies, public finances appear to be on a sustainable footing to meet the budgetary costs of ageing populations. The general government debt to GDP ratio is expected to fall substantially from 44% of GDP to some 26% by 2010. On the basis of the Commission's recommendation, the Ecofin Council is expected to adopt a formal opinion on the updated Danish convergence programme on 18 February 2003.

    [10] Commission approves major reorganisation of its Translation Service to increase effectiveness and prepare for enlargement

    The European Commission has approved a major reorganisation of its Translation Service, on a proposal by Vice-President for Reform Neil Kinnock. The main objectives are to refocus activities on the Commission's core business, increase productivity and effectiveness and introduce the translation capacity required for the new languages resulting from the next enlargement. The Service will be based around two 'Language' Directorates (in Luxembourg & in Brussels) carrying out the translation work itself, and a Resources Directorate to provide horizontal support and management. The Language Directorate in Luxembourg will be responsible for translation into the languages of the future Member States, as well as German and Dutch. The Brussels based Directorate will deal with the other languages. The Resources Directorate will increase its focus on sound financial management, set up a central system of contracts with freelance translators and manage the requests and deadlines for freelance translation. All told, the reorganisation will lead to the progressive creation of 460 posts in Luxembourg, thus contributing to the Commission's aim of consolidating its presence in this Member State. The reorganisation will be effective as of 1 July 2003. The Translation Service becomes the Directorate-General for Translation.

    [11] Romano Prodi congratulates Israeli Prime Minister Sharon following the elections

    European Commission President Romano Prodi had a long telephone conversation on 29 January with Israeli Prime Minister Ariel Sharon. President Prodi congratulated the Israeli Premier on his victory at the polls and expressed the hope that new impetus would now be given to the peace process with a view to finding a solution to the Israel-Palestine crisis. President Prodi reiterated his total condemnation of all forms of terrorism and said the process must bring the Israelis a guarantee of their right to security and peace and at the same time ensure the Palestinians enjoyed similar rights. Prime Minister Sharon thanked the President for his message and assured him that the search for a settlement that would bring peace and stability to the region was his top priority. He also said he would work to that end in consultation with the United States and without undervaluing the role Europe could play and its constructive contribution to the process.

    [12] President Prodi to visit Albania and open negotiations for a Stabilisation and Association Agreement on 31st January

    The President of the European Commission, Romano Prodi, will be visiting Albania on 31st January as part of the Commission's close relationship with this country under the Stabilisation and Association process (SAp). During his visit, President Prodi will officially open negotiations for the establishment of an enhanced contractual relationship between the EU and Albania through the conclusion of a Stabilisation and Association Agreement (SAA). President Prodi will underline the Commission's support to Albania's reform process and encourage the Albanian authorities to step-up their reform efforts. The President will also reiterate the European Integration perspective for Albania and other South-eastern European countries (Bosnia and Herzegovina, Croatia, Federal Republic of Yugoslavia and former Yugoslav Republic of Macedonia).

    [13] Commission clears Rautakirja (Finland) and Hachette joint control of Czech newspaper distributor

    The European Commission has granted clearance under the Merger Regulation to the acquisition by Finnish newspaper and magazine distributor Rautakirja of a controlling stake in HDS Retail Czech Republic, which operates retail stores and newspaper kiosks in the Czech Republic. HDS is currently wholly owned by French company Hachette Distribution Services S.A. (The operation was examined under the simplified merger review procedure)

    [14] Data protection : Microsoft agrees to change its .NET Passport system after discussions with EU watchdog

    The European Union's Working Party on data protection ("Article 29 Working Party") agreed on 29th January a working document on on-line authentication services. As well as some general material and some guidelines to be applied by all present or future on-line authentication systems, the document includes two case studies on the most prominent systems at present: the Microsoft .NET Passport system and the Liberty Alliance Project. Following discussions with the Working Party, Microsoft has agreed to implement a comprehensive package of data protection measures, which will mean making substantial changes to the existing .NET Passport system. The purpose of online authentication systems is to allow users who have registered and provided some form of identification, often including an e- mail address, and verification, often a password, to navigate through participating sites without having to introduce a different password for each one.

    [15] La Commission utilise des mesures sophistiquées pour lutter contre la pollution atmosphérique urbaine

    Le Centre commun de recherche de la Commission européenne (CCR) a lancé une étude pilote conjointe innovatrice en collaboration avec l'agence régionale italienne pour la protection de l'environnement Agenzia Regionale per la Protezione dell'Ambiente (ARPA) Lombardia en vue de mesurer la pollution atmosphérique urbaine à Milan en janvier et février 2003. Cette étude, qui déterminera l'origine des polluants nocifs, est la première à utiliser la technologie la plus récente du CCR le système d'analyse et de dimensionnement des particules par spectrométrie de masse (mass- spectrometer-based Single Particle Analysis and Sizing System - SPASS). En permettant l'identification et la mesure complètes des différents types de pollution atmosphérique, comme ceux causés par la circulation, le chauffage et les usines, la recherche de l'UE dans le domaine de l'environnement vise à obtenir des niveaux acceptables de qualité de l'air dans toute l'Europe.

    [16] Towards a strengthened energy dialogue between Norway and the EU

    The European Commission and Norway agreed on the common wish to further develop energy relations and cooperation. In a meeting held on 29 January in Brussels, Vice President of the Commission, Loyola de Palacio and Minister Einar Steensnæs, of the Royal Norwegian Ministry of Petroleum and Energy, stressed their common political desire to strengthen their dialogue. Norway is a major exporter of oil and gas to the European Union and, through the EEA Agreement, an integral part of the internal energy market.

    [17] PIB régionaux par habitant de l'UE et des pays candidats en 2000 : un quart des régions de l'UE et neuf régions sur dix des pays candidats en dessous de 75% de la moyenne de l'UE

    Selon des informations publiées aujourd'hui par Eurostat, En 2000, exprimé en standards de pouvoir d'achat, le PIB par habitant des 211 régions NUTS-2 de l'UE variait entre 47% de la moyenne de l'UE dans la région d'Ipeiros, en Grèce, et 241% de cette moyenne dans la région d'Inner London, au Royaume-Uni. Un peu plus de 10% des régions se situaient au-dessus de 125% de la moyenne de l'UE et près de 25% en dessous de 75%. Le PIB par habitant des 56 régions de niveau-2 des pays candidats s'échelonnait, quant à lui, entre 16% de la moyenne de l'UE dans la région de Nord-Est, en Roumanie, et 121% dans celle de Praha, en République tchèque, soit un écart de plus de 1 à 7 entre les deux régions.

    [18] Réunion annuelle avec la Cour des comptes

    La réunion annuelle de la Commission européenne avec les membres de la Cour des comptes abordera trois sujets : l'état d'avancement de la réforme de la Commission, la modernisation de sa gestion financière et l'élargissement de l'Union européenne. Des réunions bilatérales entre Commissaires et membres de la Cour auront lieu après le déjeuner de travail.

    [19] Opening of EPSO, the new inter-institutional EU personnel selection office, increases effectiveness and saves costs

    A ceremony will be held this evening in the European Council building to mark the official opening of the European Personnel Selection Office (EPSO). EPSO pools the resources of the different European institutions in order to ensure improved planning and organisation of the recruitment of EU officials. Candidates for EU careers will thus have one focal point, which will facilitate coherent planning of competitions and ensure common recruitment standards and principles. On request, EPSO will also assist individual institutions in organising specific recruitment drives, for example for contractual staff. EPSO will function with an annual budget of just over €21 million, 11% less than the previous expenditure across institutions despite the increased workload stemming from enlargement. EPSO's first priority will be the organisation of enlargement related competitions for all institutions, which will start in 2003.

    [20] Forum sur la contrefaçon

    Une centaine de représentants des entreprises, de la justice, de la police et des douanes des Etats membres ainsi que d'Europol et participent ce jeudi 30 janvier, à Bruxelles, à une réunion organisée par la Direction Justice et Affaires Intérieures pour traiter de la contrefaçon. Leur objectif est de réfléchir sur la manière de prévenir ce phénomène, qui atteint des proportions vertigineuses, et adapter les sanctions pénales pour mieux lutter contre ces délits. Placée sous l'égide du Forum sur la prévention du crime organisé, cette rencontre se situe dans la suite logique des propositions avancées par la Commission dans une proposition de directive concernant le respect des droits de propriété intellectuelle qui est présentée aujourd'hui (voir IP/03/144).

    [21] New institution building partnership programme in NIS countries and Mongolia to be launched

    The TACIS Institution Building Partnership Programmes (IBPP) to Support Civil Society and Local Initiatives will be officially launched at the opening conference on 30-31 January 2003 in Brussels. The conference gives project partners from NIS countries, Mongolia and from Member States the opportunity to exchange information and experience. The new IBPP programme is designed to support the institution building process in TACIS countries through partnership cooperation between NGOs, local/regional authorities and non-profit organisations. It specifically aims at reinforcing the development of initiatives at grass-root level in NIS countries and Mongolia. The programme is characterised by its direct contact with the local communities in TACIS countries and in the European Union. Under the new framework, projects will be carried out jointly with an EU partner organisation and concern the following issues ; public administration reform, economic development, social policy, urban management and environmental protection. The IBPP operates on a budget of €15 million. The EC will co-finance projects with amounts between €100,000 and €200,000.

    [22] Commission holds hearing on interoperability and open platforms for digital television and 3G mobile communications

    The European Commission will hold a public hearing on 4 February on a working report on remaining barriers to the achievement of widespread access to new services and applications of the Information Society through open platforms in digital television and 3G mobile communications.
