MIDDAY EXPRESSNews from the Press and Communication Directorate General's midday briefingNouvelles du rendez-vous de midi de la Direction Générale Presse etbCommunication16/02/06[01] Concurrence : l'enquête sectorielle sur les marchés de l'énergie confirme d'importants problèmes et définit la voie suivreLa Commission européenne poursuivra ses enquêtes menées en vertu des règles communautaires sur les ententes et les abus de position dominante concernant des cas spécifiques de fermeture des marchés du gaz et de l'électricité au moyen de contrats en aval long terme et de restriction de l'accès aux infrastructures de transport et aux capacités de stockage pour le gaz et l'électricité. La Commission envisage également de prendre certaines mesures correctives sur le plan réglementaire et en matière de concurrence afin de remédier un certain nombre d'autres dysfonctionnements graves dans le secteur de l'énergie, confirmés dans le rapport préliminaire publié récemment, qui présente les résultats de l'enquête sectorielle sur les marchés de l'énergie lancée en juin 2005 (voir IP/05/716 et IP/05/1421). Ce rapport est fondé sur les réponses fournies par les entreprises et les clients du secteur énergétique. Les parties intéressées peuvent faire part de leurs commentaires concernant le rapport préliminaire durant une période de consultation de deux mois.[02] Premier anniversaire du règlement sur les droits des passagers aériensDemain, premier jour anniversaire de l'entrée en vigueur du règlement relatif aux droits des passagers aériens, la Commission européenne rencontrera les organismes nationaux chargés de son application, pour faire le point sur la mise en œuvre de cette législation dans les Etats membres. Le règlement améliore la protection des passagers aériens en cas de refus d'embarquement, d'annulation ou de retard important.[03] Le développement durable des activités maritimes passe nécessairement, selon Joe Borg, par l'implication des acteurs côtiersPour l'avenir de régions comme la Bretagne, il est essentiel que les acteurs côtiers participent au processus de consultation qui va être lancé prochainement sur une future politique maritime pour l'Union européenne, ainsi qu' celui de gestion de la pêche. Tel est le message que M. Joe Borg, membre de la Commission européenne chargé de la pêche et des affaires maritimes, entend faire passer pendant les deux jours de sa visite en Bretagne. Demain matin, M. Borg visitera des établissements d'élevage de coquillages Carantec, puis les installations portuaires de Roscoff, où il rencontrera M. Dominique Bussereau, ministre français de l'agriculture et de la pêche. L'après-midi, il prendra la parole Brest dans le cadre d'un séminaire organisé par la Conférence des régions maritimes périphériques, pour y faire le point sur le prochain livre vert de la Commission consacré la future politique maritime de l'Union. Samedi, il visitera les ports de Saint-Guénolé et du Guilvinec, où il rencontrera des représentants des collectivités locales et du secteur de la pêche.[04] Commission signs agreement on promoting sustainable towns with UN- HABITATThe European Commission has today signed a Memorandum of Understanding with UN-HABITAT to develop the research relationship between the two organisations. UN-HABITAT is the UN's human settlement programme and the new agreement will help researchers to address issues such as urban planning and governance, housing, water management, sanitation and land use. The results of these joint research efforts will be made available to experts and policy-makers working in related fields.[05] La Commission autorise l'acquisition de Groupe Flo par GIBLa Commission européenne a autorisé, en vertu du règlement Concentrations, le projet d'acquisition de la société financière française Flo et du groupe de restauration commerciale qu'elle contrôle, par les sociétés belges Compagnie Nationale Portefeuille (CNP) et Ackermans & van Haaren (AvH), via leur société commune GIB. CNP et AvH sont principalement actives dans l'acquisition et la gestion de participations dans d'autres sociétés. Le Groupe Flo est actif dans la restauration servie table, la restauration de concession, la restauration rapide, comprenant notamment les fast-food et les cafés et le marché de l'approvisionnement du secteur de la restauration hors foyer. Il ressort de l'enquête menée par la Commission que l'opération envisagée n'entravera pas de manière significative la concurrence dans le marché commun. Cette affaire a été traitée selon la procédure simplifiée.[06] La Commission autorise l'acquisition en commun d'Autoroutes Paris-Rhin- Rhône par Eiffage et MacquarieLa Commission européenne a autorisé, en vertu du règlement sur les concentrations, le projet d'acquisition d'Autoroutes Paris-Rhin-Rhône (APRR) par Eiffage, société de construction française, et la banque australienne Macquarie. La Commission a conclu que l'opération n'entraverait pas significativement une concurrence effective dans l'Espace Economique Européen ou une partie substantielle de celui-ci.[07] Avian influenza confirmed in swans in Hungary : authorities applying precautionary measuresOn 15 February, the Hungarian authorities have informed the European Commission of confirmed cases of the H5 avian influenza virus in three dead wild swans found in the county of Bács-Kiskun, in Southern Hungary. Samples from the dead birds are now being sent to the Community Reference Laboratory in Weybridge for further tests to determine whether this is the H5N1 strain. The Hungarian authorities are applying the same precautionary measures as other Member States in which the H5N1 virus has been confirmed (Greece, Italy, Germany) or in which it is suspected (Slovenia, Austria) in wild birds. The Commission has adopted a decision on the precautionary measures to be applied in Hungary, just as it did for the other affected Member States. The avian influenza situation in all affected countries is being reviewed by the Standing Committee on the Food and Chain and Animal Health, which meets on 15-16 February.[08] Foot-and-mouth disease : regionalised import ban on Argentine beef and tighter controls on BrazilA draft Commission decision to suspend imports of de-boned and matured bovine meat from eight departments in the Argentinean province of Corientes, due to an outbreak of foot-and-mouth disease (FMD), has been backed by the Standing Committee on the Food Chain and Animal Health (SCFCAH) on 15 February. The ban will apply to all bovine meat from this area slaughtered after 4 February 2006, which was when the suspicion of disease was first notified. Meat from other regions of Argentina which are free of FMD can continue to be imported into the EU in accordance with existing import rules. The outbreak occurred in the department of San Luis del Palmar (Corrientes) in early February, and the Argentine authorities have taken rapid action to avoid the spread of the disease into other areas, notably a ban on the movement of animals in the affected areas and a reinforced vaccination campaign. With regard to Brazil, the Standing Committee backed a Commission decision on certification requirements for de-boned and matured bovine meat from the EU approved areas of Brazil. A recent Commission inspection visit found that considerable progress has been made in Brazilian traceability measures since the last EU inspection there, but further improvements in certain other areas are still needed. Therefore this decision tightens up certification requirements for Brazilian exports to the EU, notably with regard to vaccination, surveillance and animal contacts. It does not affect the current regionalised ban on EU imports from the Brazilian states of Mato Grosso do Sul, Parana and Sao Paulo, which were imposed due outbreaks of FMD.[09] Commission facilitates negotiations for the renewal of Inter- Institutional Agreement 2007-2013Following College meeting in Strasbourg on 14 February, the European Commission has transmitted to the European Parliament and the Council complementary proposals on the renewal of an Inter-Institutional Agreement (IIA) regarding the 2007-13 Financial Framework. The aim is to facilitate an agreement and speed up negotiations.
