    [01] La Commission lance une stratégie européenne globale visant promouvoir et protéger les droits de l'enfant

    La Commission européenne a adopté sa communication intitulée "Vers une stratégie européenne sur les droits de l'enfant". C'est la première fois que la Commission applique une telle approche transversale dans le domaine des droits de l'enfant. Celle-ci concerne la fois les politiques intérieures et extérieures de l'Union européenne et recouvre plus d'une dizaine de domaines politiques, comme la justice civile et pénale, l'emploi, la coopération au développement, la négociation des accords commerciaux, l'enseignement et la santé.

    [02] La Commission approuve une partie de l'aide la formation octroyée Ford Genk

    La Commission européenne a mené bien une enquête approfondie qui a permis d'établir que l'aide de €6,24 millions que la région flamande envisage d'accorder en faveur de la formation l'usine Ford-Werke, située Genk, en Belgique ("Ford Genk"), est compatible avec les règles du traité CE régissant les aides d'Etat. Toutefois, elle a également constaté qu'une somme de €6,04 millions était destinée financer des actions de formation que Ford aurait mises en oeuvre de toute façon. Cette aide ne favoriserait pas l'intérêt commun en multipliant les possibilités de formation, mais fausserait la concurrence et les échanges entre les Etats membres. Par conséquent, la Commission est parvenue la conclusion que l'aide de €6,04 millions n'est pas compatible avec le marché unique.

    [03] Commission investigates support to Greek shipyard

    The European Commission has decided to extend its formal investigation under EC Treaty State aid rules into aid granted by Greece to Hellenic Shipyards S.A. (HSY), based at Skaramangas near Athens. In 2004, the Commission opened an investigation into amendments to an investment plan financed by investment aid to HSY as well as into several loans and guarantees granted to the shipyard by the state-owned bank ETVA. The Commission has now extended this inquiry into several potential aid measures that Greece did not notify : capital injections, guarantees and loans received by HSY from public sources, for example in relation with railway contracts and with the construction of ferries, cross-subsidisation between HSY's military and civil activities, and an indemnifying clause granted by the Greek State to HDW/Ferrostaal against the liability to repay unlawful aid received by HSY. The extension of the formal investigation will allow interested parties to comment on the additional measures under examination. It does not prejudge the outcome of the procedure.

    [04] Ouverture d'une enquête sur les mesures contre la crise de l'influenza aviaire en Italie

    La Commission européenne a décidé d'ouvrir une procédure d'examen l'égard des mesures prises pour faire face la crise de l'influenza aviaire en Italie. A ce stade, les aides inhérentes cette mesure apparaissent difficilement justifiables la lumière des règles applicables en matière d'aides d'Etat.

    [05] Commission authorises Poland to grant rescue aid for bus company Przedsiębiorstwo Komunikacji Samochodowej w Olkuszu S.A.

    The European Commission has decided not to raise objections to planned rescue aid for Przedsiębiorstwo Komunikacji Samochodowej w Olkuszu S.A. The aid is justified by serious social difficulties as 111 people could loose employment if the aid is not granted to the beneficiary.

    [06] La Commission autorise la Belgique financer la construction d'installations de transbordement afin de redynamiser la ligne ferroviaire Lanaken (B) – Maastricht (NL)

    La remise en service de la ligne ferroviaire fermée entre Lanaken et Maastricht stimulera les activités de transport ferroviaire de marchandises. La mesure ne constitue pas une aide et est donc compatible avec le bon fonctionnement du marché commun.

    [07] Commission launches consultation on fishing less for better returns

    The European Commission has just adopted a Communication on "Implementing sustainability in EU fisheries through Maximum Sustainable Yield" (MSY). Maximum sustainable yield is the highest yield that may be taken from a fish stock without lowering its productive potential for future years. At the World Summit on Sustainable Development (WSSD) in Johannesburg in 2002, Member States of the EU committed themselves to maintaining or restoring fish stocks to levels that can produce at MSY no later than 2015. The Communication outlines the steps by which the Commission proposes implementing an MSY approach, the benefits this will bring once stocks have been restored to this level, and the options for managing the 'transitional' period for stocks which are currently overfished.

    [08] Marchés des valeurs mobilières : la Commission invite les Etats membres signer la convention de La Haye sur les titres

    La Commission européenne a émis son appréciation juridique relative la convention de La Haye sur les titres, traité international prévoyant un dispositif juridique unique pour déterminer la propriété des valeurs mobilières détenues sous forme électronique. Elle répond ainsi au Conseil des ministres de l'UE qui lui a demandé de clarifier quatre points de droit spécifiques. La Commission considère que trois de ces points ne posent aucune difficulté majeure, mais met en garde, pour le quatrième, contre l'application de plusieurs droits conventionnels dans les systèmes de règlement de titres qui compromettrait la stabilité financière. La Commission recommande donc que la Communauté européenne et les Etats membres signent maintenant la Convention, et que la directive sur le caractère définitif du règlement soit modifiée pour que les systèmes de règlement de titres ne soient régis que par un seul droit conventionnel.

    [09] La Commission donne son aval au plan de restructuration financière du radiodiffuseur public portugais RTP

    La Commission européenne a décidé que l'accord de restructuration financière signé entre le gouvernement portugais et l'organisme public de radiodiffusion RTP en septembre 2003 est compatible avec les règles du traité CE relatives aux aides d'Etat. Applicable jusqu'en 2019, cet accord vise réduire progressivement la dette de RTP, qui s'élève €1 milliard environ. Au terme d'une enquête, la Commission a conclu que la quasi-totalité de cette dette est imputable un sous- financement constant des missions de service public de RTP dans le passé, et que l'aide financière désormais accordée par l'Etat est proportionnée au besoin de financement public de RTP.

    [10] Commission approves proposed merger of Canadian mining companies Inco and Falconbridge, subject to conditions

    The European Commission has cleared under the EU Merger Regulation the proposed acquisition of Falconbridge by Inco, both Canadian companies active in the mining, processing and refining of nickel and other metals. The Commission's in-depth investigation has shown that the concentration, as initially notified, would have led to a substantial impediment of effective competition on certain nickel and cobalt markets in the European Economic Area (EEA). To address the Commission's concerns, the merging parties have committed to divest Falconbridge's sole nickel refinery and related assets and have proposed to sell these assets to LionOre, an international mining company. The Commission has concluded that the proposed transaction, as modified, would not significantly impede effective competition in the EEA or a significant part of it. The Commission's clearance decision is conditional upon full compliance with the commitments.

    [11] Direct taxation : Commission requests Spain to end infringement to the Parent-Subsidiary Directive

    The European Commission has decided to send Spain a formal request to amend a rule which automatically assumes the existence of an abuse in cases where a Spanish company pays a dividend to a company established in another Member State which is owned by a company resident in a third country. The Commission considers these rules to be contrary to the Parent-Subsidiary Directive. The request is in the form of a reasoned opinion, the second stage of the infringement procedure under Article 226 of the Treaty. If Spain does not amend its legislation within two months, the Commission may refer the case to the Court of Justice.

    [12] Fiscalité directe : la Commission saisit la Cour des manquements de l'Italie et du Luxembourg concernant la transposition de la directive sur les sociétés mères et leurs filiales

    La Commission européenne a décidé de saisir la Cour de justice européenne des manquements de l'Italie et du Luxembourg concernant l'adoption et la notification des mesures nécessaires la mise en œuvre de la directive 2003/123/CE, qui modifie la directive concernant les sociétés mères et leurs filiales. Ces Etats membres n'ont pas rempli leurs obligations, malgré les demandes formelles de la Commission du 5 juillet 2005 (IP/05/941).

    [13] "Key role for border regions in the EU jobs and growth strategy", Danuta Hübner tells Saarbrücken conference

    European Regional Policy Commissioner Danuta Hübner outlined today in Saarbrücken, Germany, how cross-border cooperation can help border regions tackle the challenges they may face and deliver more growth and quality employment. The Commissioner delivered her key note speech on the conference "The future of border regions in Europe", attended by about 150 participants from border regions across Europe. The conference is organised by the Minister-President of the Land of Saarland, Peter Müller while German Federal Minister of the Interior Wolfgang Schäuble and heads of border regions featured among the speakers.

    [14] May 2006 compared to May 2005 : volume of retail trade up by 0.8% in euro area ; up by 2.2% in EU25

    In May 2006, compared to May 2005, the volume of retail trade grew by 0.8% in the euro area and by 2.2% in the EU25. Compared to April 2006, the retail sales index fell by 0.6% in the euro area and by 0.1% in the EU25. In May 2006, compared to May 2005, retail trade of "food, drinks and tobacco" dropped by 0.6% in the euro area, but grew by 0.6% in the EU25. The non food sector increased by 2.0% and 3.7% respectively. Among the Member States for which data are available, total retail trade rose in Latvia (+20.8%), Estonia (+19.9%), Sweden (+12.0%), Slovakia (+9.6%), Poland (+6.0%), Denmark, Lithuania and Finland (+5.5% each), Luxembourg (+4.6%), Slovenia (+4.0%), the United Kingdom (+3.9%), Portugal (+2.1%), France (+1.4%), Spain (+1.3%) and Belgium (+0.9%), while falls were recorded in Germany (-2.0%) and Austria (-0.1%). These first estimates come from Eurostat.
