  • [01] La Commission entame une consultation publique sur la protection des mineurs utilisant un téléphone portable

    La Commission européenne a lancé aujourd'hui une consultation publique sur les risques potentiels de l'utilisation du téléphone portable par les enfants. Des contributions de toutes les parties intéressées sont attendues, notamment d'associations de protection de l'enfance, de parents ou de consommateurs, d'opérateurs de réseau mobile, de fournisseurs de contenus, de fabricants de téléphones et de réseaux, et de régulateurs. La consultation se déroulera jusqu'au 16 octobre 2006.

    [02] La Commission autorise le projet de concentration entre Alcatel et Lucent

    La Commission européenne a autorisé, en vertu du règlement sur les concentrations de l'UE, le projet de concentration entre la société française Alcatel et l'entreprise américaine Lucent Technologies, qui exercent toutes deux leurs activités dans le secteur des télécommunications. Elle a considéré que cette opération n'entraverait pas de manière significative une concurrence effective dans l'Espace économique européen ou dans une partie substantielle de celui-ci.

    [03] Commission clears acquisition of Turmed by Carlyle and Vista

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of joint control of Turmed, S.L.U. (Turmed) of Spain by The Carlyle Group (Carlyle) of the US, through its fund CEP II, and Vista Desarrollo S.A., S.C.R. (Vista) of Spain, a fully owned subsidiary of Banco Santander Central Hispano S.A. (Banco Santander) of Spain. Carlyle is a global private equity investment group holding a portfolio of companies active in various sectors. Vista is a private equity fund. Turmed is active in the tourism sector, mainly as a tour operator, travel agency and provider of airline services and cruise operations. The operation was examined under the simplified merger review procedure.

    [04] Commission clears acquisition of Fives-Lille by Charterhouse

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of sole control of the Fives-Lille group (Fives-Lille) of France by Charterhouse Capital Limited (Charterhouse) of the UK. Charterhouse provides equity capital and fund management services. Fives-Lille is mainly active in industrial engineering for the automotive, steel, aluminium and cement sectors. The operation was examined under the simplified merger review procedure.

    [05] La Commission autorise l'acquisition de AMEC SPIE par PAI

    La Commission européenne a autorisé, en vertu du règlement Concentrations, le projet d'acquisition de l'entreprise française AMEC SPIE S.A. par PAI Partners S.A.S. (PAI), société également française. PAI est une société de fonds de capital-investissement (private equity). AMEC SPIE S.A. est une entreprise de fourniture de services régionaux multitechniques et fourniture de services multitechniques au secteur nucléaire, au secteur du pétrole et du gaz, au secteur ferroviaire ainsi qu'aux secteurs des communications et des technologies de l'information. Il ressort de l'enquête menée par la Commission que l'opération envisagée n'entravera pas de manière significative la concurrence dans le marché commun. Cette affaire a été traitée selon la procédure simplifiée.

    [06] TVA : la Commission propose d'autoriser 17 Etats membres à appliquer un taux réduit aux services à forte intensité de main d'œuvre jusqu'à la fin de 2010

    La Commission européenne propose d'autoriser dix-sept Etats membres à commencer ou à continuer d''appliquer, selon le cas, un taux réduit de taxe sur la valeur ajoutée (TVA) jusqu'au 31 décembre 2010 pour certains services à forte intensité de main-d'œuvre (rénovation de logements privés, coiffure, lavage de vitres, soins à domicile et petites réparations). Cette proposition met en œuvre les dispositions de la directive 2006/18/CE, laquelle autorise les Etats membres qui optent pour cette possibilité à appliquer une TVA réduite auxdits services.

    [07] VAT : Commission launches infringement proceedings against Germany, Greece, Ireland and Italy

    The European Commission has decided to refer Germany to the Court of Justice on account of its treatment of services supplied by executors of wills. In addition the Commission has issued a reasoned opinion (second step of the infringement procedure provided for in article 226 of the EC Treaty) concerning the requirements imposed by Greece on invoicing and on the storage of electronic invoices. Reasoned opinions have been also addressed to Ireland concerning its treatment of public bodies as non taxable persons and to Italy concerning its restrictions on VAT charges and VAT refunds which are against the 6th VAT Directive and against the Eights and Thirteenth VAT Directives, respectively. If the relevant national legislations are not amended in order to comply with the respective reasoned opinions, the Commission may decide to refer these matters to the European Court of Justice.

    [08] Fiscalité directe : la Commission demande à la Belgique, à l'Espagne, à l'Italie, au Luxembourg, aux Pays-Bas et au Portugal de mettre un terme à l'imposition discriminatoire des dividendes sortants

    La Commission européenne a envoyé à la Belgique, à l'Espagne, à l'Italie, au Luxembourg, aux Pays-Bas et au Portugal une demande officielle leur enjoignant de modifier leur législation fiscale en ce qui concerne les paiements de dividendes sortants aux entreprises. Ces six Etats membres imposent en effet les dividendes versés aux sociétés étrangères plus lourdement que ceux versés aux entreprises domestiques. La Commission estime ces pratiques contraires au traité CE et à l'accord EEE, jugeant qu'elles constituent un obstacle tant à la libre circulation des capitaux qu'à la liberté d'établissement. La demande se présente sous la forme d'un avis motivé émis en vertu de l'article 226 du traité CE. Si les Etats membres concernés n'y répondent pas de façon satisfaisante dans les deux mois, la Commission peut porter le dossier devant la Cour européenne de justice.

    [09] European Corporate Governance Forum

    The European Corporate Governance Forum has adopted a statement on risk management and internal control. The statement considers that there is no need to impose an EU obligation on boards to certify the effectiveness of internal controls as required in the US by the Sarbanes-Oxley Act. The European Corporate Governance Forum has also agreed to recommend to the Council of the European Union and the European Parliament the introduction of a rule obliging financial intermediaries to facilitate the exercise of voting rights in general meetings of listed companies by or on behalf of their clients. The European Corporate Governance Forum was established by Commission Decision of 15Â October 2004 and provides high level advice to the European Commission in the field of corporate governance.     [10] Premier trimestre 2006 : l'UE25 a enregistré un déficit des échanges courants de €36,7 milliards ; excédent de €11,5 milliards pour la balance des services

    Selon les dernières révisions, la balance des opérations courantes de l’UE25 avec les pays tiers a enregistré un déficit de €36,7 milliards au premier trimestre 2006, comparé à un déficit de €17,1 millards au premier trimestre 2005 et à un déficit de €29,1 milliards au quatrième trimestre 2005. Au premier trimestre 2006 par rapport au premier trimestre 2005, un déficit plus important a été enregistré pour le compte des biens (€-47,8 milliards contre -20,8 milliards), tandis que les excédents du compte des services (€+11,5 milliards contre +9,3 milliards) et du compte des revenus (€+12,6 milliards contre +6,0 milliards) ont augmenté. Le déficit de la balance des transferts courants a légèrement augmenté (€-13,0 milliards contre -11,6 milliards). L'excédent enregistré dans le compte des services (€+11,5 milliards) est principalement le résultat d'un excédent des postes "services financiers" (+6,2 milliards), "autres services aux entreprises" (+5,9 milliards), "transports" (+3,4 milliards), ainsi que "services informatiques et d'information" (+2,4 milliards) et d'un déficit des postes "voyages" (-5,7 milliards) et "redevances et droits de licence" (-2, 1 milliards). Ces données provisoires publiées par Eurostat.

    [11] Stavros Dimas visits Cyprus

    European Commissioner Stavros Dimas, responsible for the Civil Protection Mechanism, is travelling to Cyprus and will be meeting with the Cypriot government today in order to discuss further EU support in coping with the evacuation flows. The Commissioner stated: "I would like to thank the Cypriot authorities for their support for the victims of the events in Lebanon. My visit to Cyprus will allow me to get a better idea of what is still needed on the ground and to discuss how we can further improve the situation through the Civil Protection Mechanism." Cyprus has turned to the Civil Protection Mechanism for help on Saturday to ask for support as well as assistance in removing bottlenecks in the relief and evacuation efforts. In response the Commission's Monitoring and Information Centre immediately dispatched an expert team to assist the Cypriot authorities and to assess the situation. The team includes experts made available by Italy, Estonia, Finland and the Commission and will assist the local authorities in streamlining the relief and evacuation efforts. The Mechanism is also being used to coordinate the Member States' in-kind contributions to the humanitarian operation in Lebanon. Several Member States have already shipped humanitarian supplies in the last few days. The Commissioner will bring a message of solidarity and pledges of further support to Cyprus. By providing expert support and concrete civil protection assistance, Europe is extending its hand of solidarity to both Cyprus and Lebanon.
