    [01] Réglementation aéroportuaire : la Commission propose un paquet capital

    La Commission européenne a adopté un "paquet aéroports" consistant en trois initiatives clés : une proposition de directive en matière de redevances aéroportuaires, une communication sur la capacité, l'efficacité et la sécurité des aéroports en Europe, et un rapport sur la mise en œuvre de la directive sur l'assistance en escale. Ce paquet de mesures est axé sur le rôle des aéroports dans le développement et la compétitivité du marché intérieur européen de l'aviation et marquera l'avenir de la réglementation aéroportuaire en Europe en assurant la convergence réglementaire entre les Etats membres.

    [02] Réforme de la PAC : la réforme du secteur des fruits et légumes permettra d'améliorer la compétitivité, de protéger les producteurs contre les crises, d'augmenter la consommation, de renforcer la protection de l'environnement et de simplifier les règles en vigueur

La Commission européenne a proposé aujourd'hui des réformes profondes de l'organisation commune des marchés pour les fruits et légumes, afin d'aligner ce secteur sur les autres secteurs réformés de la politique agricole commune. Les propositions visent à améliorer la compétitivité et l'orientation vers le marché du secteur des fruits et légumes, à réduire les fluctuations des revenus liées aux crises, à augmenter la consommation, à renforcer la protection environnementale et, si possible, à simplifier les règles et alléger la charge administrative. La réforme encouragera un plus grand nombre de producteurs à rejoindre les organisations de producteurs, mettra à la disposition des OP un plus large éventail d'instruments de gestion des crises, intègrera le secteur des fruits et légumes dans le régime de paiement unique, exigera un taux minimal de dépenses pour les mesures environnementales ainsi qu'un meilleur financement de la production biologique et des mesures de promotion et supprimera les aides à l'exportation pour le secteur concerné. La Commission espère que le Conseil et le Parlement approuveront la réforme, qui n'aura pas d'incidence sur le budget, avant la fin du premier semestre 2007, permettant ainsi son entrée en vigueur en 2008.

    [03] EU action programme starts cutting unnecessary administrative burdens

    The European Commission further steps up its efforts to reduce unnecessary burdens on businesses. An action programme demonstrates in concrete terms the way in which the Commission intends to work with Member States to cut administrative burdens on businesses by a quarter by 2012. The programme focuses on information obligations in thirteen selected priority areas including company law, employment relations, taxation/VAT, statistics, agriculture and transport. Its aims are to measure the cost of the administrative burden in these key sectors and identify information obligations for which proposals will subsequently be adopted to remove unnecessary burdens. In addition, the Commission has already identified ten concrete reduction measures, for unprecedented fast track action which could be decided upon at the March Spring Council. These measures alone could in one fell swoop, reduce the burdens on businesses by €1.3 billion on an annual basis.

    [04] Commission fines members of gas insulated switchgear cartel over €750 million

    The European Commission has fined eleven groups of companies a total of €750,712,500 for participating in a cartel for gas insulated switchgear projects, in violation of the EC Treaty's ban on restrictive business practices (Article 81). The companies are ABB, Alstom, Areva, Fuji, Hitachi Japan AE Power Systems, Mitsubishi Electric Corporation, Schneider, Siemens, Toshiba and VA Tech. For most of the duration of the infringement, a former Alstom subsidiary, bought by Areva four months before the end of the cartel, is jointly and severally liable with Alstom for the infringement. The Areva group is liable for the infringement for the period after its purchase of the subsidiary, up to the end of the cartel four months later. Between 1988 and 2004, the companies rigged bids for procurement contracts, fixed prices, allocated projects to each other, shared markets and exchanged commercially important and confidential information. ABB received full immunity from fines under the Commission's leniency programme, as it was the first company to come forward with information about the cartel. The total fines imposed in this case (€750,712,500) make it the largest set of fines ever imposed on a single cartel, and the fine of €396,562,500 on Siemens, Germany constitutes the largest ever fine that the Commission has imposed on a single company for a single cartel infringement.

    [05] La Commission publie le rapport intermédiaire de son enquête sur l'assurance des entreprises ; une audition publique se tiendra en février

    La Commission européenne a publié son rapport intermédiaire concernant l'enquête sur la concurrence dans le secteur de l'assurance des entreprises. Ce dernier démontre l'existence d'une fragmentation des marchés et fait ressortir des éléments susceptibles d'avoir une incidence négative sur la concurrence. Lancée en juin 2005 (voir IP/05/719), l'enquête sectorielle vise à favoriser une meilleure compréhension du fonctionnement du secteur. A terme, la Commission devrait ainsi pouvoir détecter les distorsions de concurrence qui, si nécessaire, pourraient ensuite être supprimées au moyen de l'application des règles antitrust par la Commission elle même ou par les autorités de concurrence des Etats membres. Avant de formuler des conclusions définitives, dont la publication est prévue pour septembre 2007, la Commission invite l'ensemble des parties prenantes à soumettre leurs avis et observations sur les premiers résultats de l'enquête. La période de consultation s'achèvera le 10 avril. La Commission organise également une audition publique à Bruxelles le 9 février, afin de permettre un échange de vues sur son rapport intermédiaire.

    [06] Commission approves regional aid maps 2007-2013 for Bulgaria, Cyprus and Romania

    The European Commission has approved under EC Treaty state aid rules the regional aid maps covering the period 2007-2013 for Bulgaria, Cyprus and Romania. These decisions form part of a wider exercise to review regional aid systems in all Member States in accordance with the new Regional Aid Guidelines (see IP/05/1653 and MEMO/05/491) adopted in December 2005. The new Guidelines aim at re-focussing regional aid on the most deprived regions of the enlarged EU, while allowing to improve competitiveness and to provide for a smooth transition. The maps of eighteen other Member States have already been approved by the Commission (see IP/06/1176, IP/06/1393, IP/06/1451, IP/06/1528 and IP/06/1871).

    [07] La Commission approuve les subventions accordées par l'Italie en vue de promouvoir l'achat de décodeurs numériques à la condition qu'elles soient neutres sur le plan technologique

    La Commission européenne considère que les subventions accordées par l'Italie en 2006 en vue de promouvoir l'achat de décodeurs numériques ne sont pas contraires aux règles du traité CE régissant les aides d'Etat (article 87, paragraphe 1) étant donné qu'elles sont proposées pour tous les décodeurs quel que soit le type de plateforme de transmission utilisé, qu'elles sont dès lors neutres sur le plan technologique et proportionnées à l'objectif poursuivi, qui était de promouvoir le passage à la télévision numérique et à l'interopérabilité. La Commission a toutefois décidé que les subventions accordées en 2004 et 2005 étaient incompatibles avec les règles en matière d'aides d'Etat, car elles n'étaient pas neutres sur le plan technologique et faussaient la concurrence en excluant la radiodiffusion télévisuelle par satellite (voir IP/05/1657). Enfin, la Commission a décidé que les radiodiffuseurs qui ont le plus bénéficié des aides d'Etat devaient les rembourser. Elle continue donc à soutenir le passage à la radiodiffusion et télévision numérique conformément à ses communications de 2003 et 2005 (IP/03/1276 et IP/05/595) pour autant que les aides publiques soient compatibles avec les règles en la matière.

    [08] Free movement of capital : Commission refers Spain to European Court of Justice over law extending the functions of the Spanish electricity and gas regulator

    The European Commission has decided to refer Spain to the European Court of Justice because it considers that certain provisions of Spanish legislation that extends the powers of the Comisión Nacional de Energía (CNE), the Spanish electricity and gas regulator, constitute unjustified restrictions on the free movement of capital and the right of establishment in violation of EC Treaty rules (Articles 56 and 43 respectively).

    [09] Free movement of capital : Commission closes infringement procedure against Italy concerning acquisition of stakes in domestic banks

    The European Commission has decided to close an infringement procedure against Italy concerning prudential supervision of the acquisition of stakes in domestic banks. The Commission will continue to monitor the financial services sector to eliminate any possible obstacles to the free movement of capital not justifiable on prudential supervision grounds that could hinder cross-border consolidation in the EU financial sector. Where the Commission identifies breaches of EU law in relation to direct investment by EU financial institutions, it will, where a violation has been identified, pursue infringement cases vigorously, as it has already done in other areas of barriers to intra-EU direct investment.

    [10] Clubs de football : la Commission clôt la procédure engagée contre la France concernant l'interdiction de faire appel public à l'épargne

    La Commission européenne a clos la procédure d'infraction engagée contre la France en raison de sa législation interdisant aux clubs de football et aux autres clubs sportifs professionnels d'entrer en bourse. Cette interdiction constituait une entrave injustifiée à la libre circulation des capitaux, en violation du traité CE (article 56). La décision de clore l'affaire a été prise suite à une modification satisfaisante de la législation française.

    [11] Insurance : Commission scrutinises exemption of Irish Voluntary Health Insurance Board from EU rules

    The European Commission has decided to send Ireland a formal request to submit its observations on the continued legality of the exemption of the Irish Voluntary Health Insurance Board (VHI) from certain EU rules on non- life insurance. This follows a complaint to the Commission alleging that the VHI is unlawfully pursuing insurance activities without being subject to the First Non-Life Insurance Directive. The Commission's request takes the form of a "letter of formal notice", the first stage of infringement procedure under Article 226 of the EC Treaty. Ireland is asked to send its reply within one month. Depending on the analysis of this reply, the Commission will decide whether or not to issue a "reasoned opinion" formally calling on the Irish Government to amend the relevant legislation.

    [12] Libre circulation des étudiants : la Commission envoie des lettres de mise en demeure à l'Autriche et à la Belgique

    La Commission européenne a décidé d'envoyer à l'Autriche et à la Belgique des "lettres de mise en demeure" concernant des restrictions d'accès à leurs systèmes d'enseignement supérieur pour les titulaires de diplômes d'enseignement secondaire obtenus dans d'autres Etats membres. Ces deux pays auront maintenant un délai de deux mois pour répondre à la Commission européenne. La Commission reconnaît que la question de l'accès aux établissements d'enseignement supérieur est particulièrement sensible dans plusieurs Etats membres. Tout en poursuivant son rôle de gardienne des Traités, elle demeure ouverte au dialogue avec les autorités autrichiennes et belges.

    [13] Commission authorises German scheme to promote environmentally friendly heavy vehicles

    The European Commission has decided not to raise any objections to a German State aid scheme that aims to help transport operators acquire heavy vehicles with better emission performance. The scheme will promote positive environmental effects by reducing harmful road traffic emissions. This is especially important for congested urban areas, which have difficulties meeting European anti-pollution requirements.

    [14] La Commission approuve le financement public d'infrastructures à l'aéroport Tortolì-Arbatax

    La Commission européenne a décidé d'autoriser le gouvernement italien à financer l'extension des infrastructures de l'aéroport Tortolì-Arbatax. La mesure a pour but de stimuler le développement régional et les communications dans la province d'Ogliastra. En outre, les nouvelles infrastructures permettront à l'aéroport Tortolì-Arbatax de se conformer aux exigences actuelles en matière de sécurité aéroportuaire.

    [15] Maritime transport – tonnage tax : Commission opens investigation concerning Denmark

    The European Commission today opened an investigation concerning a proposal by Denmark to amend its flat-rate tonnage-based tax scheme (tonnage tax) for shipping companies. The Danish authorities intend no longer to require companies benefiting from this tax scheme to send the authorities financial information relating to their transactions with their foreign subsidiaries.

    [16] Commission clears acquisition of H.C. Starck by Advent and Carlyle

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of joint control of the H.C. Starck group of companies: of Germany by Advent International Corporation (Advent) of the US and Carlyle Europe Partners II, L.P., part of the Carlyle Group (Carlyle), also of the US. Advent and Carlyle are private equity investment companies. H.C. Starck is active in refractory metals and related compounds, advanced ceramics, conductive polymers and other electronic chemicals for various industrial applications. The operation was examined under the simplified merger review procedure.

    [17] László Kovács expresses concerns on US announcement to introduce 100% scanning of US bound cargo containers

    László Kovács, European Commissioner responsible for Taxation and Customs Union, expresses, in a letter to US Secretary of Homeland Security Chertoff, his concerns on US announcement to introduce 100% scanning of US bound cargo containers. "I am extremely concerned by the possible introduction of the US HR1 legislation which would introduce 100% scanning of US bound cargo containers. I naturally support the principle of increased security checks at the borders and I have always been supportive of any actions in this direction. However, every measure taken must be first assessed as to its effectiveness. Currently, US and EU customs are preparing pilot actions in order to determine whether a 100% scanning policy is effective. I hope the US will await the results of these actions before taking any decision towards a 100% scanning legislation. Applying risk analysis for the selection of cargo containers to be checked prior to leaving the EU for the US would find a balance between legitimate trade facilitation and customs security, an approach that the European Union has always supported. I am afraid that a 100% scanning legislation could disrupt trade and cost legitimate EU and US businesses a lot of time and money."

    [18] Stavros Dimas to address climate change issues in Davos

    European Environment Commissioner Stavros Dimas will participate from 25- 27 January in the World Economic Forum annual meeting in Davos, Switzerland, where the economic implications of climate change will be one of the major issues. Over 2,000 leaders from business, politics, academia, the media and civil society are expected to attend. Commissioner Dimas will speak at five events focusing on climate change, aviation emissions, biofuels and urban mobility. He will also hold a series of private meetings with other participants. Commissioner Dimas will explain current EU policies and new initiatives such as the landmark energy and climate change package proposed by the Commission on 10 January. In view of the increasing urgency of controlling climate change, he will also underline the need to accelerate the pace of international discussions on a new global agreement to succeed the Kyoto Protocol after 2012.
