While registration will be voluntary, there are clear rules on what information registrants would have to supply: In whose name am I speaking? What are my goals? How am I funded, and by whom? The initiative offers an opportunity to all interest representatives to underscore that lobbying EU institutions is a legitimate and useful activity, and one that can stand up to full public scrutiny.[02] Communication de la Commission : vers une approche intégrée des réseaux transeuropéens de transport, d'énergie et de télécommunicationMieux connecter, mieux intégrer et mieux coordonner le développement des infrastructures européennes est un objectif essentiel, qui s'inscrit dans la stratégie de la Commission sur la croissance, l'emploi et la compétitivité dans l'Union. C'est pourquoi, à l'initiative du Président de la Commission, José Manuel Barroso, Jacques Barrot a présidé un groupe de pilotage composé de Viviane Reding, Danuta Hübner, Dalia Grybauskaité, Stavros Dimas, JoaquÃn Almunia et Andris Piebalgs, visant à développer une approche intégrée des réseaux transeuropéens d'énergie, de transport et de télécommunication. A l'issue d'un an de travaux, le groupe présente une communication qui dresse un état des lieux pour chacun des trois réseaux transeuropéens, puis aborde les possibilités de synergies entre les réseaux, la conciliation entre développement des réseaux et respect de l'environnement, et explore des voies d'amélioration du mode de financement des réseaux.[03] La Commission étend la procédure formelle d'investigation pour les centres de coordination belgesLa Commission européenne a décidé d'étendre la procédure ouverte en 2002 en vertu des règles du traité CE relatives aux aides d'Etat au sujet du régime fiscal des centres de coordination (voir IP/02/325). Elle permet ainsi à la Belgique et aux tiers intéressés d'apporter leurs commentaires suite à l'arrêt du 22 juin 2006 de la Cour de Justice européenne. Cet arrêt annule partiellement les mesures transitoires prévues par la Commission dans sa décision du 17 février 2003, déclarant l'incompatibilité du régime des centres de coordination (voir IP/03/242). Compte tenu des commentaires reçus, la Commission décidera quelles mesures transitoires elle aurait dû prévoir à compter du 17 février 2003.[04] Commission opens in depth investigation into Hungarian intra-group interest taxationThe European Commission has opened a formal investigation procedure under EC Treaty state aid rules into a Hungarian tax scheme, relating to the taxation of interest in the context of intra-group transactions. The Commission doubts at this stage that the scheme would constitute a general measure and wants to investigate further whether it is in line with the state aid rules and whether it could distort competition. The opening of proceedings enables interested parties to submit their comments on the measure and does not prejudge the outcome of the investigation.[05] Commission authorises extending fiscal aid to wind-propelled commercial cruising vessels in the NetherlandsThe European Commission has decided not to raise any objections to an extension of a Dutch fiscal aid scheme in order to apply reduced remittances for maritime navigation to seafarers of wind-propelled commercial cruising vessels (CCVs). The measure aims to make the Netherlands more attractive to shipping companies that are active in operating wind-propelled CCVs.[06] La Commission autorise une aide aux passagers sur les liaisons aériennes intérieures en GuyaneLa Commission européenne a autorisé un régime d'aide d'Etat à caractère social destiné à bénéficier aux résidents de la Guyane. Cette mesure permettra de répondre au désavantage permanent dont souffrent les habitants de cette région ultrapériphérique, confrontés à des difficultés de transport bien plus élevées que les habitants de la France métropolitaine, compte tenu d'un grand manque d'infrastructures de transport sur le territoire de la Guyane.[07] Commission approves public financing of bus transport in MaltaThe European Commission has decided that payments made by Malta to finance public transport on its territory do constitute State aid but are compatible with the common market. Instead of signing public service contracts, Malta had unilaterally imposed public service obligations on the bus operators of the Public Transport Association. In exchange, it pays the companies public service compensation.[08] La Commission lance une série de nouvelles procédures d'infractionLa Commission européenne a décidé aujourd'hui de prendre des mesures supplémentaires dans 399 actions en justice à l'encontre des Etats membres qui, selon elle, ont enfreint leurs obligations découlant du droit communautaire. Il s'agit de la première série trimestrielle de procédures d'infractions que la Commission lance en 2007.[09] La Commission traduit la France devant la Cour de justice concernant sa législation sur la rémunération des comptes courantsLa Commission européenne a décidé de traduire la France devant la Cour de justice européenne pour ne pas avoir totalement modifié sa législation ("code monétaire") interdisant formellement aux banques de rémunérer les comptes courants de leurs clients. Cette saisine de la Cour de justice représente le troisième stade de la procédure d'infraction prévue par l'article 226 du traité CE.[10] La Commission réagit à la législation grecque excluant certaines sociétés des marchés publicsAprès l'envoi d'une lettre de mise en demeure le 18.10.2006 et un avis motivé le 15.12.2006 au gouvernement hellénique, la Commission européenne a décidé de saisir la Cour de Justice européenne contre la Grèce concernant la compatibilité de la Décision Ministérielle Commune 24014/2005 relative aux justificatifs nécessaires pour l'application de la loi 3310/2005, telle que celle-ci est modifiée par la loi 3414/2005. Cet acte prévoit la soumission obligatoire et systématique au Conseil National de Radiotélévision sous peine d'exclusion, une série d'extraits de casiers, ainsi que d'autres certificats et déclarations tant des participants que d'autres personnes dites "interconnectées" opérant sur le marché des media.[11] Free movement of services : infringement proceedings against Austria, Spain and the United KingdomThe European Commission has taken action to put an end to obstacles to the free movement of services in Austria, Spain and the United Kingdom. The Commission has decided, under Article 228 of the EC Treaty, to send a letter of formal notice asking Luxembourg for full information on its implementation of a European Court of Justice judgment concerning the posting of workers from non-EU countries. The Commission has also decided, under Article 228 of the EC Treaty, to send Spain a further reasoned opinion requesting it to comply immediately with a Court judgment concerning private security services. Finally, the Commission has sent a formal request to the United Kingdom concerning the recognition by pharmacies of prescriptions from other Member States. This formal request takes the form of a "reasoned opinion", the second stage of the infringement procedure laid down in Article 226 of the EC Treaty. If there is no satisfactory reply within two months, the Commission may refer the matter to the European Court of Justice.[12] Marchés publics : procédures d'infraction à l'encontre de la Grèce et de l'ItalieLa Commission européenne a décidé de poursuivre l'Italie devant la Cour de justice européenne en raison de la procédure d'adjudication suivie par la municipalité de L'Aquila pour l'acquisition de tramways. La Commission a également décidé d'adresser une demande formelle à la Grèce concernant un projet forestier à Thessalonique. Cette demande formelle prend la forme d’un "avis motivé", deuxième étape de la procédure d'infraction prévue à l'article 226 du traité CE. En l'absence de réponse satisfaisante dans un délai de deux mois, la Commission pourra saisir la Cour de justice.[13] Public procurement : infringement proceedings against Czech Republic and GermanyThe European Commission has sent a formal request to Germany regarding the long-standing practice of German public broadcasting organisations to award works, supply and service contracts without conducting European-wide competitive tendering procedures. The Commission has also sent a formal request to the Czech Republic regarding the award of contracts for forestry services. These formal requests take the form of "reasoned opinions", the second stage of the infringement procedure laid down in Article 226 of the EC Treaty. If there is no satisfactory reply within two months, the Commission may refer the matter to the European Court of Justice.[14] Public procurement : Commission closes infringement cases against GermanyThe European Commission has decided to close four infringement cases against Germany in the area of public procurement. These cases concern transport of works of art ; bus transport services in the city of Worms ; legal services in Brandenburg, Mecklenburg-Vorpommern, Sachsen, Sachsen- Anhalt and Thüringen ; and waste disposal services and municipal cooperation.[15] Qualifications professionnelles : procédures d'infraction contre la France et le LuxembourgLa Commission européenne a décidé, au titre de l'article 228 du traité CE, d'adresser une lettre de mise en demeure au Luxembourg pour lui demander des informations détaillées au sujet de l'exécution d'un arrêt de la Cour de justice européenne concernant l'établissement des avocats. La Commission a également décidé, au titre de l'article 228 du traité CE, d'adresser un nouvel avis motivé à la France pour lui demander de se conformer immédiatement à un arrêt de la Cour concernant la transposition d'une directive sur les qualifications professionnelles.[16] Internal Market : infringement proceedings against Czech Republic, Hungary, Italy, Portugal and SpainThe European Commission has decided, under Article 228 of the EC Treaty, to send a reasoned opinion to Portugal and letters of formal notice to Italy and Spain asking those Member States for full information on their execution of Court judgements relating to implementation of a Directive on rental and lending rights. The Commission has also decided to formally request the Czech Republic and Hungary to implement fully in national law a Directive on the activities and supervision of institutions for occupational retirement provision. This formal request takes the form of a "reasoned opinion", the second stage of the infringement procedure laid down in Article 226 of the EC Treaty. If there is no satisfactory reply within two months, the Commission may refer the matter to the European Court of Justice.[17] Free movement of services : Commission acts to remove obstacles to provision of sports betting services in Denmark, Finland and HungaryThe European Commission has taken action to put an end to obstacles to the free movement of sports betting services in Denmark, Finland and Hungary. The Commission has formally requested these Member States to amend their laws following consideration of their replies to letters of formal notice sent in April 2006 (see IP/06/436), in which the Commission sought to verify whether the restrictions in question are compatible with Article 49 of the EC Treaty, which guarantees the free movement of services. The Commission considers that the restrictions in question are not compatible with existing EU law and that the measures taken by these Member States to restrict the free movement of sports betting services have not been shown to be necessary, proportionate and non-discriminatory. Furthermore, in the Commission's view, existing national operators cannot be regarded as non- profit operations, given that they are subject to strict annual revenue targets and often rely on commercial retail outlets to market their various gambling services. These formal requests take the form of "reasoned opinions", the second stage of the infringement procedure laid down in Article 226 of the EC Treaty. If there is no satisfactory reply within two months, the Commission may refer the matter to the European Court of Justice.[18] Marchés publics : la Commission prend des mesures à l'encontre de sept Etats membres pour garantir la mise en Å“uvre du droit communautaireLa Commission européenne a décidé de traduire la Belgique, la Finlande, la Grèce, le Luxembourg, le Portugal, l'Espagne et la Suède devant la Cour de justice européenne pour ne lui avoir toujours pas communiqué les mesures nationales transposant certaines directives de l'Union européenne relatives aux marchés publics.[19] Freedom of establishment : infringement proceedings against AustriaThe European Commission has decided to formally request Austria to modify its Animal Breeding law, which in the Commission's view contains conditions that hinder the provision in Austria (Tyrol and Salzburg provinces) of bovine artificial insemination services by foreign artificial insemination stations. This decision takes the form of a reasoned opinion, the second stage of the infringement procedure laid down in Article 226 of the EC Treaty. The Commission has also decided, under Article 228 of the EC Treaty, to send a letter of formal notice asking Austria for full information on its implementation of a European Court of Justice judgement concerning the provision of services by foreign boiler inspection bodies in Austria.[20] Car taxation : infringement procedures against Malta and RomaniaThe European Commission has decided to send to Romania and Malta formal requests to amend their car registration tax rules which discriminate against second-hand car brought from other Member States into these countries. The requests take the form of "letter of formal notice", the first stage of the infringement procedure laid down in Article 226 of the EC Treaty. If the Commission does not receive satisfactory responses from these Member States within two months, it may proceed with the second stage of the said procedure and ultimately bring the cases before the Court of Justice.[21] Accises : prix minimaux de vente au détail des cigarettesLa Commission européenne a décidé de saisir la Cour de justice à l'encontre de la France en raison de la fixation par cet Etat de prix minimaux de vente au détail des cigarettes. En effet, la Commission estime, conformément à une jurisprudence constante de la Cour de justice européenne, que ces prix minimaux sont contraires à la législation communautaire, faussent la concurrence et ne bénéficient qu'aux fabricants, en protégeant leurs marges bénéficiaires. Pour atteindre l'objectif de réduction de la consommation de tabac, la Commission préconise une augmentation des droits d'accises sur les cigarettes. De plus, la Commission a décidé de classer la procédure d'infraction lancée contre la Belgique étant donné la mise en conformité de sa législation, conformément à la demande officielle faite par la Commission le 4 juillet 2006 (IP/06/866).[22] Marché ferroviaire européen : la Commission traduit 10 Etats membres devant la CourLa Commission européenne a décidé d'entamer des procédures d'infraction à l'encontre de dix Etats membres qui n'ont pas encore communiqué les mesures de transposition en droit national de deux directives essentielles du "deuxième paquet ferroviaire". Ces directives visent à garantir un degré élevé de sécurité et d'interopérabilité dans le secteur ferroviaire européen.[23] Tachygraphe numérique pour le transport routier : la Commission adresse un avis motivé à la GrèceLa Commission européenne a adressé à la Grèce un avis motivé – dernière étape avant le dépôt d’une plainte officielle devant la Cour de justice européenne – pour non-respect de la législation européenne relative au tachygraphe numérique. L'installation de cet appareil vise à améliorer la sécurité routière et le respect des durées de conduite et des périodes de repos.[24] Road transport - rules for admission to the occupation : Commission sends reasoned opinion to GreeceThe European Commission has sent a reasoned opinion to Greece for its failure to comply with European rules on admission to the occupation of road haulage operator and passenger transport operator. This is the last step before possible referral to the Court of Justice. With the rapid growth of road transport, these rules are essential to the proper functioning of the internal market and the quality of professional transport as regards efficiency, road safety and compliance with social legislation.[25] Port reception facilities for ship-generated waste and cargo residues : Commission sends a reasoned opinion to EstoniaThe European Commission has sent a reasoned opinion to Estonia for failure to respect EU legislation on better availability and use of port reception facilities for ship-generated waste and cargo residues. The rules on the necessary inspections designed to ensure respect of this legislation were inadequately transposed into Estonian law.[26] Ship classification societies : Commission takes Slovakia to Court of JusticeThe European Commission has announced that it would be taking Slovakia to the European Court of Justice for failing to comply with Community rules on the use of ship classification societies.[27] Système de suivi du trafic des navires et d'information : la Belgique visée par la CommissionLa Commission européenne a adressé un avis motivé à la Belgique pour non-respect d'une décision de la Cour de justice européenne. Comme le prévoit la décision du 15 décembre 2005, la Belgique doit prendre les mesures nécessaires pour transposer dans sa législation une directive européenne sur la mise en place d'un système communautaire de suivi du trafic des navires et d'information. Malgré les efforts déjà accomplis, cette transposition par la Belgique reste incomplète plus de trois ans après l'échéance initiale (le 5 février 2004).[28] Commission refers Greece to Court over animal welfare infringementsThe European Commission has decided to refer Greece to the European Court of Justice for failure to properly implement and enforce EU legislation on animal welfare in transport and at slaughter. The decision to take this action against Greece follows persistent short-comings identified in the field of animal welfare over a number of years. The standard of animal welfare in Greece remains below par and the necessary legislation has not been adequately implemented. Therefore, the Commission has no alternative but to refer the case to the Court of Justice.[29] Commission takes Poland to court to protect threatened wildlife habitatsThe European Commission is taking Poland to the European Court of Justice over the construction of the Augustow and Wasilkow road bypasses through the Rospuda Valley. The construction of the two roads would damage important nature areas like primeval woodland and other natural habitats of European importance. The Commission supports the upgrading of road infrastructure in Poland but it does not accept the unjustified irreversible damage that will be caused by the bypasses. As work has started on these two construction projects the Commission is equally asking the Court of Justice for interim measures to ask Poland to suspend the works immediately.[30] France : la Commission décide de saisir la Cour avec sursis d'exécution dans l'affaire de la pollution par les nitrates des eaux de surface en BretagneLa Commission européenne a décidé de poursuivre une seconde fois la France devant la Cour de justice européenne en raison de la pollution par les nitrates de sources d'eau potable en Bretagne. La France ne s'est en effet pas conformée à un arrêt de la Cour de justice de 2001 la condamnant pour infraction à la réglementation communautaire sur la qualité de l'eau potable accessible au public. La Commission propose de demander à la Cour d'imposer à la France une somme forfaitaire supérieure à 28 millions d'euros et une astreinte journalière de 117.882 euros. Au vu de l'annonce par la France de l'élaboration de mesures importantes supplémentaires, la Commission propose de sursoir à l'exécution de la saisine pour faciliter le dialogue avec les autorités françaises et examiner en détails le contenu de ces mesures.[II] Other news - Autres nouvelles[31] Commission decisions to withdraw five discontinued GMOs backed by Member StatesEuropean Commission proposals to withdraw from the market five GMOs, which have been allowed to be sold in the EU up to now, were endorsed by the Standing Committee on the Food Chain and Animal Health on 20 March. The five GMOs are Bt176 maize, GA21xMON810 maize, Ms1Rf1 oil seed rape, Ms1Rf2 oil seed rape and Topas 19/2 oil seed rape. Under the GM food and feed Regulation 1829/2003, any GM products that were legally on the market before the Regulation entered into force could continue to be marketed until 18 April 2007. However, if the companies responsible for these GMOs wanted to continue marketing them in the EU after that date, they had to submit an application to the Commission. For the five GMOs affected by these decisions, no applications for renewal are expected. This is due to the fact that they are no longer being used, and the companies no longer have any commercial interest in them. Moreover, according to information provided to the Commission, all stocks of food and feed derived from these GMOs have been used up. However, there is the possibility that some food and feed products on the market may still contain trace amounts of these GMOs. Accordingly, the Commission proposals require the respective companies to identify and withdraw seeds of any of these GMOs from the market. Recognising that this cannot be done overnight, however, a 0.9% adventitious presence of these five GMOs will be allowed in food and feed products for the next five years. The decisions will now be formally adopted by the Commission and will enter into force by the end of April.
